AN ORDINANCE OF THE CITY OF CLEARWATER
FLORIDA, RELATING TO FIRE PREVENTION ANU
PROTECTION; AMENDING SECTIONS 93.01, 93.21, 93.23,
93.26 AND 93.28, CODE OF ORDINANCES, TO CLARIFY
THE DUTIES OF THE FIRE CHIEF AND TO ADOPT THE
NATIONAL FIRE CODES, 1988 EDITION, WITH CERTAIN
AMENDMENTS THERETO AND PROVIDING FOR THE
ENFORCEMENT THEREOF; REPEALING SECTION 93.231,
CODE OF ORDINANCES, RELATING TO SMOKE
DETECTORS; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Pinellas County Construction Licensing Board has mandated that
all municipalities In the County of Pinellas adopt the 1988 edition of the Life Safety
Code, which is contained in the National Fire Codes published by the National Fire
Protection Association; and
WHEREAS, the City Commission desires to adopt rules and regulations to
improve public safety by promoting the control of fire hazards; regulating the installation,
use, and maintenance of equipment; regulating the use of structures, premises, and open
" areas; providing for the abatement of fire hazards; and establishing responsibilities and
procedures for enforcement of these rules and regulations; and
WHEREAS, the City Commission wishes to exercise the police powers of the
City for the preservation and protection of public health, peace, safety and welfare of its
citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Section 93.01, Code of Ordinances, Is amended to read:
See. 93.01 Duties of Chief
(a) Generally. The duties of the chief of the fire department shall
be to have charge and control of the fire department of the city and any
other fire fighting assistance whose service may be offered in the
_ extinguishment of fire and protection of the city from fire. The chief, or
the chiefs, He; or his duly authorized representative, shall order and
superintend the work of such company and shall from time to time make
such recommendations as may be found necessary and he thinks proper
for the better and more adequate protection of the city.
(b) (el Chief to enforce state fire marshal's regulations. All rules
and regulations issued by the state fire marshall under authority of F.S. §
633.15, shall be enforceable by the chief of the fire department, and the

from other officials of the city in the discharge of such duties.

(c) (d) Apparatus not to be assigned to private use; exception. No
engine or other apparatus used for extinguishing fires shall be assigned to
any private 'use or enterprise, or used therein, or carried or placed beyond
the proper place assigned to it unless for repairs, without written consent
of the chief of the fire department and approval of the city manager.
Section 2. Subsection (a) of Section 93.21, Code of Ordinances, is
amended to read:
See. 93.21. Adoption of National Fire Codes.
(a) There is hereby adopted NFPA 1, Fire Prevention Code of the
National Fire-Protection Association, and its incoroorated standards and

Protection Association and listed in Annex A of the NFPA Fire Prevention

Protection Association, 1998 1'985 edition, is amended as follows:
Q Section 1-7.2 of NFPA 1, concerning the permitting of bonfires
and outdoor rubbish fires, Is amended to Include:
(1) ( Location restricted. No person shall kindle or maintain any
bonfire or outdoor rubbish fire or authorize any such fire to be kindled or
maintained on any privately-owned land unless the location is not less
than fifty (50) feet or some other distance approved by the Clearwater
Fire Department from any structure, and adequate provision is made to
prevent fire from spreading to any structure.
{?} Attendance of open fires. A bonfire or outdoor rubbish
fire shall be constantly attended by a competent person until the fire is
extinguished. This person shall have a garden hose connected to a water
supply, or other fire extinguishing equipment readily available for use.
(3) (e) Chief may prohibit. The chief of the fire department
may In his diserat4en prohibit any or all bonfires and outdoor rubbish fires
when atmospheric conditions or local circumstances make such fires
hazardous or constitute a public nuisance.
Section 3-1.1.10 of NFPA 1 concerning the required access for
fire apparatus Is amended to read:
All premises that the fire department may be called upon to protect
in case of fire shall be rovided with suitable gates, access roads and fire
lanes.
Fire lanes shall be at least twenty feet (6.1 m) in width with road
edge closest to the building at least ten feet (3.05 m) from the building.
An dead-end road more than six hundred (600) feet 163 m long shall be
rovided with a turn-around at the closed end at least sixty feet 8.3 m)
In diameter.
The designation, use, and maintenance of fire lanes r,on,-private
property shall be accomplished as specified by the fire chief or fire
marshal.

It shall be unlawful for an person to ark motor vehicles on or
otherwise obstruct, any fire lane.
(e) Section 4-2.1 of NFPA 24, concerning the number and location of
fire hydrants, Is amended to read:

Hydrants shall be provided in sufficient number and be located in a
manner that will enable the fire flow needed to be delivered throw h hose
lines about an Important structure. The fire flow needed and the hydrant
location shall be determined b the fire chief or fire marshal but in no
case shall hose lengths be eater than 500 ft. for single family
structures and 300 ft. for commercial structures.

Section 4. Section 93.26, Code of Ordinances, is amended to read;
Sec. 93.26. Appeal from denial of permit or decision based on codes.
(a) Where any person seeks relief from a decision of a fire official
enforcing an of the revisions of this code Including permits,
certificates waivers alternate materials alternate methods, approvals,
or variances or matters of Code inter retations that person may request
reconsideration of the fire official's decision b appealing In writing to
the fire chief or fire marshal within 15 days of the recei t of the decision
stating the reasons.-why relief is sought and what other decision the erson
is seeking. The fire -chief or fire marshal shall, within ten days after
receiving a co of the appeal in writing, hold a hearing and decide the
question after hearing testimony from all concerned persons. The fire
chief or fire marshal shall render a written decision within five days after
the hearing is completed. Such hearing shall be an informal administrative
hearing.
(b) An person seeking relief from a decision of the fire chief or
fire marshal regarding provisions of this Article may appeal to the
Clearwater Building Board of Adjustment and Appeals within 15 days after
receipt of written notice of the decision b the fire chief or fire marshal.
An appeal to the Clearwater Building Board of Adjustment and Appeals
shall be in writing and directed to the fire chief or fire marshal. Co ies

Section 5. Subsection (a) of Section 93.28, Code of Ordinances, is
amended to read:
Sec. 93.28. Penalty applicable to article.
(a) Any person who shall violate any of the provisions of this article
hereby adopted or fail to comply therewith, or who shall violate or fail to
comply with any order made thereunder, or who shall build in violation of
any detailed statement of specifications or plans submitted and approved
thereunder, or any certificate or permit issued thereunder, and from
which no appeal has been taken, or who shall fail to comply with such an
order as affirmed or modified by the fire chief or city manager
marshal, any board of adjustment and appeals having jurisdiction, or by a
court of competent jurisdiction, within the time fixed therein, shall
severally for each such violation and noncompliance respectively, be

Section 6. Section 93.231, Code of ordinances, is hereby repealed.
