ORDINANCE NO. 4713-88
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A PORTION OF A 10-FOOT DRAINAGE AND UTILITY
EASEMENT IN LOT 35, SUN TREE ESTATES, PINELLAS COUNTY,
FLORIDA; PROVIDING AN EFFECTIVE DATE.
WHEREAS, it has been requested by John and Leslie Neuman, owners of certain
real property located in the City of Clearwater, Florida, that the City vacate a
certain drainage and utility easement; and
WHEREAS, after proper public notice and public hearing thereon, the City
Commission finds that said easement is not necessary nor required for municipal use
and it is deemed to be to the best interest and advantage of the City and the general
public that the same be vacated; now therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
The south 8 feet of the existing 10-foot drainage and utility easement
on the north side of Lot 35, Sun Tree Estates, as recorded in Plat
Book 78, Page 99, of the public records of Pinellas. County, Florida,
less and except the west 10 feet,
be and the same is hereby vacated, closed and released, and the City of Clearwater
hereby quitclaims and releases all of its right, title and Interest thereto to the persons,
firms or corporations entitled thereto bylaw.
Section 2. The City Clerk is hereby directed to record this ordinance in the
Public Records of Pinellas County, Florida.
Section 3. This ordinance shall take effect immediately upon adoption.
