ORDINANCE NO. 4711-88
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE UTILITY SYSTEM; AMENDING SECTIONS
50.02 THROUGH 50.07 AND 50.09, CODE OF ORDINANCES'
TO ESTABLISH DEFINITIONS, PROVIDE FOR
RESPONSIBILITIES OF OWNERS AND TENANTS, AND
ESTABLISH PROCEDURES FOR TENANT ACCOUNTS;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the 1988 Florida Legislature enacted Chapter 88-332, Laws of
Florida, also known as House Bill 506, which prohibits a municipality from taking legal
action against the present tenant or owner of property served by municipal utility
services to recover unpaid utility charges incurred by a former tenant, requires the
municipality to notify the landlord of such nonpayment by a tenant, and prohibits a
municipality from discontinuing service until after three consecutive monthly periods

of nonpayment by a tenant; and
WHEREAS, such legislation was signed by the Governor into law and took effect
on October 1, 1988; and
WHEREAS, such legislation creates a new exception to the previously established
law of Florida relating to municipal liens on property served by municipal utilities, and
compels each municipality providing municipal utility services to treat tenants as a
separate classification of utility customers in order to comply with the law; now
therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Sections 50.02, 50.03, 50.04, 50.05(a) and (b), 50.06(a), 50.07 and
50.09, Code of Ordinances, Code 'of Ordinances, are amended to read:
Sec. 50.02. Definitions.
For the purposes of this title, the words "shall" and "must" mean the statement is
mandatory, while the words "will" and "may" mean the statement is advisory.
Definitions applicable to this title are as follows:
"Applicant" shall mean the person who applies for and authorizes utility services

"Rental unit" shall mean a premises lensed by a tenant.
'Tenant" shall mean the parson having the right of occupancy of a premises
receiving utility services, other then the owner of the premises, whether the right of
occupancy is derived from a lease or otherwise.

(a) Owner. The furnishing of water, gas, wastewater and sanitation services
bring a substantial and valuable benefit to the land and premises. The owner appHeant
at?eustorner of any premises serviced with water, gas, wastewater and sanitation
services shall be res onsible for assarne-respensy-€er the-tetal--ef all utility
service charges due against the premises, except to the extent that such charges may
be incurred by a tenant of the premises who is the customer accordingz to the utilitv
system account records whieh-he-owns-er-purehases. The payment of such char es
'phis--assttmpt-ien-of-respessfbffIty shall be a necessary condition to the continuance or
inception of utility services to the premises, and failure to pay such charges when
billed shall constitute grounds to terminate services to those premises.
(b) Tenant. A tenant of any premises serviced with water, gas, wastewater
and sanitation services who is the customer according to the utility system account
records shall be responsible for all utility service charges incurred at the remises.
The indebtedness for unpaid utility service charges incurred b a tenant at one
premises shall be personal to the tenant, and shall transfer and become cumulative to
that person at the next or an succeedin remises occupied b that person and served
b the utility system of the City. The amount due or length of time in arrears shall
not be affected by relocation of a tenant from one premises to another.
Sec. 50.04. Application for service.

(a) Establishing auplicant status.
(1) An applicant requesting utility service as an owner in possession shall
provide proof of ownership, in the form of a copy of the deed, title insurance olicy or
closing statement with the application for service.

(1) Sewers. Any person who desires to have eenneet his or her premises
preperty,-p}aee-e£-basiness, er`-residenee served by wRh the sanitary sewer system of
the city shall comply with the provisions of this title and shall pay the fees and
connection charges as herein set out. For new connections, all required The fees shall
must be paid at the time a plumbing permit is issued by the building department.
{2} Water, gas, sanitation. An person who desires Every-appHeant--whe

whether the building is old or new, building permit number if the building is new, and

(1) No application for munieipa4 utility service shall be finally accepted
from any applicant who is delinquent on any utility service chargestor eusteme+r with
respect to premises to which service has been discontinued for nonpayment of utility

such time as the charges are bill is paid. In cases where the premises is rental
property, the tenant is the customer, and the tenant has left owing unpaid utility
charges, the account will be finaled and the deposit will be applied to the unpaid
charges. Owners and tenants who have incurred delinquent utility service charges
shall be 'listed in an uncollected final bill listing to be maintained b the utility
department. An application for utility services shall not be accepted from any person
listed in the uncollected final bill listing until the unpaid charges are aid.

(3" The director of the utilities department may receive an application
for utility service and may provide commencement of the service applied for, elf
subject to a check of utility service records to determine whether the application he

application cannot be accepted, written notice of this fact shall be given to the
applicant, with not less than ten (10) days but not more than fifteen (15) da follow in
1 recei2t of the notice to correct the defect. If the defect is not corrected within the
time provided, service shall be discontinued without further notice.
Sec. 50.05. Deposit, fees, service charges and rate schedules.
(a) Generally. The city utilities department will furnish and install water and
gas service connections and tap the mains, as well as provide sanitation service, for

(b) Deposits for service:
(1) Water. Each meter service shall be secured by a minimum deposit of
thirty dollars ($30.00) or three (3) times the average monthly bill for all services
(includes sanitation and sewer), whichever Is greater.
(2) Gas. Each meter service shall be secured by a minimum deposit of
twenty dollars ($20.00) or three (3) times the average monthly bill, whichever Is
greater.
(3) Sanitation. Each customer shall be secured by a minimum ton-dollar
r' ($10.00) deposit or three (3) times the average monthly bill for service when the
customer is not on the city water system, whichever Is greater.
(4) Sewer. Each customer shall be secured by a minimum ton-dollar
($10.00) deposit or three (3) times the average monthly bill for service when the
customer is not on the city water system, whichever Is greater.
(5) Deposits of cash equivalents money-here4o-are-and-hereafter
depesited-wily he-eity to guarantee payment of bills. Commercial deposits in excess
.s of one thousand dollars ($1,000.00) may be made by a surety bond written by an

insurance a-bending company authorized to do business in the State of Florida
appreved--by- he-eity-at'lerney, or through furnishing a letter of credit from a bank, by
making an assignment to the city of a savings and loan Investment certificate or

approved by the city attorney.
" (6) A housing authority created pursuant to Chapter 421, Florida
Statutes, may fulfill deposit requirements for the agency or tenants of the agency by

Sec. 50.06. Accounts due; method of billing and when delinquent.
(a) All meters shall be read monthly and bills for all charges shall be rendered
monthly. Where any meter is defective or any person the-eastemer has prevented the
meter from being read, then the customer shall pay for that month an amount equal to
the average amount charged for the two (2) preceding months preeedinHhe4allHre-e!
4he-fneter-er4eflure4 read-4he-meter. Charges for each service shall be arranged
as separate items on all bills. The bill shall be mailed or delivered to the customer
according to a regular monthly billing cycle monthly--either-es-a-separate-ill-er-w#•th
ether-utility-bills. It shall be the duty of the customer to inquire of the utility
de2artment in the event of nonreceipt of a bill, and the failure Fa lure to receive a bill
shall not constitute a defense for nonpayment. Any bill which remains unpaid on and
after twenty-one (21) days from the date the bill was rendered shall be considered
delinquent and service to the customer may be terminated. In cases where the
premises is rental property, notice of delinquency shall be Riven to the owner and the

tenant and utility service shall be 6iscontinued after three consecutive months of
nonpayment by the tenant. In such cases, payment of the entire delinquent account
shall be required within seven da after rendition of the third consecutive monthly
bill in order to avoid termination of service and the billing statement shall include or
be accompanied by a notice to that effect.
Sec. 50.07. City to have lien for charges, assessmentsi when same effectivey

The city shall have, as security for the collection of any utility rates,
assessments or charges due or to become due, for the use or consumption of utilities
supplied to any-building~er-te any premises, tet-,-p4eee-orpareel-&F4and, a lien upon
the remises wltieh-sueh-buildl ag-shaHrbe-aRuated-er to which such utilities are
supplied. Such lien shall become effective immediately upon the distribution of the
utilities to the premises er•-property-supplied, except to the extent _Rrohibited by
Section 180.135, Florida Statutes, as amended by Chapter 88-332, haws of Florida,
relating to unpaid utility charges by former tenants.
Sec. 50.09. Discontinuance of service; suit for collection of charges,
assessments
The city, by and through its officers, agents or employees, may, subject to the
notice and appeal process provided in section 50.06, discontinue utility service to any
baidngs-er any premises, -let-er-arty-pareel-of- and upon which any utility rates,

assessments or charges shall be accrued, or may institute suit for collection of such
utility rates, assessments or charges in any court of competent jurisdietionpexcept to
the extent prohibited by Section 180.135, Florida Statutes, as amended by Chapter 88-
332, Laws of Florida, relating to unpaid utility charges by former tenants.
'Section 2. This ordinance shall take effect immediately upon adoption.
