AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,;
AMENDING SECTION 50.05(c)(3), CODE OF ORDINANCES, TO
INCREASE THE SANITARY SEWER UTILITY RATES;.: '
PROVIDING AN EFFECTIVE DATE. a
WHEREAS, the current sanitary sewer utility rate has been effective since
October i 1985; and
WHEREAS, the Florida Legislature enacted Senate Bill 204 in 1987 which`
requires that all effluent discharged to surface waters from treatment facilities in the

Tampa Bay Area be in compliance with certain Advanced Wastewater Treatment

(A WT) standards; and
WHEREAS, the three Clearwater sanitary sewer Water Pollution Control (WPC) ?i'

plants must be modified and expanded to meet those AWT effluent. standards; and
WHEREAS, the anticipated cost of upgrading the WPC plants to AWT standards
Is expected to be in excess of $40 million; and
- ' WHEREAS, the current operating costs of the . sanitary sewer system are
increasing beyond that point where sufficient revenues will be available to pay for the

operation and maintenance of the sanitary system, 115 per centum (115%) of the 3
current and proposed bond issue service requirements, and all reserve and other
payments required to be made pursuant to the bond ordinance, and the bond ordinance
requires that the rates, fees, rentals and other charges shall not be reduced so as to be
insufficient to provide gross revenues for such purposes; and
WHEREAS, the United States Environmental Protection Agency and the State of s
Florida Department of Environmental Regulation require provisions for periodic t
reevaluation of the sanitary sewer utility rate structure and annual notification to r
s
utility users of the rate structure; now, therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY

a. There is hereby established a uniform schedule of rates and charges for the use
or availability of use of €er the sanitary sewer utility system for both residential and
nonresidential accounts. The sanitary sewer utility UWAy rate shall be a monthly fee
schedule consisting of a minimum lum"um charge for an assigned volume of water
associated with each water meter size, shown as the basic allowance in the following
table,, plus a charge of one dell" and twenty-fi-ve eenta ($140 per one hundred (100)
cubic feet for water consumed above the assigned volume. Such rates will take effect
on October 1 of 1988, 1986, 1990 and 1991, as shown in the following table and the
rate which takes effect on October 1, 1991, shall remain in effect thereafter unless
amended:
