enact local laws relating to the operation of vessels within the waterways of Its
jurisdiction; and

WHEREAS, the City Commission of the City of Clearwater has determined that

it is in the Interest of the health, safety, and welfare of all the people In the City of

. WHEREAS, the City Commission finds that the waters of the Gulf of Mexico,
bays, bayous, canals, and other waterways within the corporate limits of the City are
significant assets of all the people, resident and nonresident alike, requiring that they

be monitored, maintained, and regulated In a manner consistent with environmental
preservation; and
WHEREAS, the City Commission finds that the delicate plant and animal life

which comprise the marine ecological system within the City of Clearwater have been
damaged, and the public health and welfare harmed
by the uncontrolled discharge of

sewage and harmful waste from vessels; and
WHEREAS, the City Commission finds that the use of the City's navigable
waters for residential purposes, whether temporary or permanent, presents a
substantial threat to this unique and environmentally sensitive area due' to the
a likelihood that sewage, waste products, trash, and garbage will be,.disposed of or
discharged Into the City's navigable waters;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER:
Section 1. Article I of Ch6pter 114 of the Clearwater City Code Is hereby
repealed In its entirety and the following shall be substituted therefor:

Section 114.01. Authority of City to regulate waterways.
The City shall possess all rights permitted by law to regulate the use of all
waterways within the City and the conduct of all persons using such waterways.
Section 114.02. Definitions.

(f) "Discharge" Includes, but is not limited to, any spilling, leaking, pumping,

(h) "Harbormaster" shall mean the harbormaster of the City, or the
harbormaster's designee or duly appointed substitute or deputy.
(1) "Hazardous chemicals or substances" shall mean as defined by state and
federal law or regulations.
(j) "Holding tank" shall mean a receptacle on a vessel which is used to contain ,
sewage.

(k) Live-aboard vessel shall mean a vessel which is occupied or used b one

(n) "Mooring" means the act of docking, anchoring, Intentional grounding, or
otherwise securing a vessel such that any portion of the vessel Is in the water.
(o) "Navigable waters" sha11 mean all portions of those waters, up to and
including the mean high water mark, located within the corporate limits of the City,
which are of such size and so situated as may be used for purposes common or useful
to the public, and shall include all waterways or portions of waterways which are
susceptible of being used in their natural and ordinary condition as a highway for
commerce, over which trade and travel are or may be conducted in the customary
modes of trade and travel on water. This definition shall not apply to landlocked,
inland waters to which the general public does not have access or the right of use.
(p) "Person" shall mean an Individual, partnership, corporation, or other legal
entity. As used herein, the term includes but is not limited to any owner, master,
officer, or employee of any vessel.
(q) "Petroleum products" shall mean oil, gasoline, diesel fuel, petroleum or
chemical compositions of any kind which contain petroleum In any form, including fuel
oil, oil sludge, oil or fuel residue, and oil refuse.
(r) "Sewage" shall mean human body wastes and the contents and wastes from
toilets, marine sanitation devices, and other receptacles designed, intended, or used to
' receive or retain human body wastes.
(s) "Sewage pump-out station" shall mean a system consisting of a pump, with
or without a tank, with sewer transfer lines having an approved connection to the city
sewer system, which can be temporarily connected to a vessel for the purpose of
removing sewage from the vessel's holding tank or head. Any such system may be
either fixed or portable.
(t) "Vessel" shall mean any watercraft, boat, barge, or any other contrivance
of any description, type, and purpose which is capable of being reasonably used as a
means of transportation of, or occupied by, persons or property upon navigable waters,
whether or not powered by any machine or device.
Section 114.03. Placing, discharging or depositing trash, debris, etc., into

(a) It shall be unlawful for any person to place, discharge or deposit, or cause
or allow to be placed, discharged or deposited, either from or out of any vessel of any
kind, or from the shore, dock, seawall, wharf or structure of any kind, any sewage,
trash, garbage, petroleum products, hazardous chemicals or substances, or refuse
material of any kind or description Into navigable waters.

(b) it shall be unlawful for any person to place, discharge or deposit, or cause
or allow to be placed, discharged or deposited any material or matter described In
subsection (a) in or on any place on the bank or shore of any navigable waters or on the
bank or shore of any tributary where the some Is reasonably likely to be washed Into
such navigable waters, either by ordinary tidal actions or by the action, of rain, floods
or otherwise.
(c) This section shall not prohibit operations in connection with the
Improvement of navigable waters or the construction of public works which have been
approved by the Florida Department of Natural Resources, the Florida Department of
Environmental Regulation, the U.S. Army Corps of Engineers, the U.S. Environmental
Protection Agency, or the U.S. Department of Interior, nor shall anything herein
prohibit the deposit of any material pursuant to a permit issued by the Secretary of
Defense of the United States with the consent, where necessary, of the State of
Florida; nor shall this section be construed as prohibiting that which Is permissible in
accordance with any provision of the U.S. Code or Florida laws relating to navigable
waters or pollution control.
Section 114.04. Equipment of watercraft and vessels.
All vessels within or upon the navigable waters shall at all times have present,
accessible, and in good working order all equipment required by state or federal law or
regulation. Any vessel which Is equipped with a marine toilet or other marine
sanitation device shall comply with sanitation device type and performance standards,
rules, and regulations stated in Title 40 CFR, fart 140, or in applicable provisions
promulgated by the Coast Guard, or the secretary of the department in which the
Coast Guard is operating, under the authority of 33 U.S.C. Sec. 1322 and such ot'rler
applicable federal law relating to marine sanitation and pollution control.
Section 114.05. Live-aboard vessels.
(a) Prohibited; exceptions. It shall be unlawful for any person to moor any
live-aboard vessel at any location within or upon the navigable waters in the city for
any period of time In excess of 72 hours, except as follows:
(1) At a marina facility for which conditional use approval has been
obtained, or a marina facility in existence as of October 13, 1985, for which
conditional use approval would otherwise be required; or
(2) At a dock or facility at which live-aboard activities are not
specifically authorized, pursuant to the terms of a temporary permit Issued to the
owner or operator of the vessel by the Harbormaster.

{b} Temporary permits. The harbormaster shall have the authority to issue n
temporary live-aboard permit, which permit shall be limited to 15 days, to the owner
or operator of a vessel to be moored at a dock or facility at which live-aboard
activities are not specifically authorized, upon payment of a permit fee not to exceed
$15.00. As conditions precedent to the issuance of n temporary permit, the owner,
operator, or person In charge of the vessel shall consent to an Inspection by the
harbormaster of the vessel's marine sanitation and safety equipment; agree that no
more persons will reside on the vessel than it was designed to reasonably
accommodate, and in no instance shall more persons reside thereon than there are
permanent accommodating berths; agree not to place, discharge or deposit, or cause or
allow to be placed, discharged or deposited, any sewage, trash, garbage, petroleum
products, hazardous chemicals or substances, or refuse material of any kind or

s:.r the period covered by said permit; demonstrate that the written permission of the
'- dock or facility owner to moor the vessel thereto during the period covered by the
temporary permit has been obtained; and provide evidence of the availability of toilet
facilities for the vessel's occupants while moored. Not more than six temporary live-
aboard permits may be issued to the owners or operators of the same live-aboard
vessel in any twelve-month period, and not more than two such permits may be issued
in succession for the same vessel. The permit may be revoked at any time by the
Harbormaster upon a showing of probable cause that a condition precedent to the
issuance of the permit has not been met or has been violated after Issuance of the

permit and, upon such a showing, no additional permit shall be Issued to the permit
holder, or to any person shown to have committed a violation, for a period of one year
from the date of the violation. Any permit granted under this subsection shall be valid
only for the place or facility specified upon the permit and shall be conspicuously
posted according to the directions of the Harbormaster.
Section 114.06. Pump-out systems.
(a) equipment to be provided. Not later than December 31, 1988, all marina
facilities in the City at which live-aboard vessels are permitted shall provide sewage
pump-out stations, or direct sewage pump-out connections, which are designed,
Installed and maintained in good working order to permit the pumping out of sanitary
holding tanks or heads on vessels into the city sewer system.
{b} Inspections of facilities by Harbormaster. At such reasonable times as the
Harbormaster deems appropriate or convenient, and without notice, the Harbormaster

It shall be unlawful for any person to dive or jump from any dock, pier, seawall,
piling, bridge, bridge structure, or any other structure which Is owned, operated, or
leased by the City and located on, over, within, or adjacent to any public waters,
regardless of navigability, within the City. This prohibition shall not apply where such
an activity is specifically permitted by the Harbormaster, which permission shall be
evidenced by official City signs or written consent.
Section 2. This ordinance shall take effect immediately upon adoption.

may inspect any marina facility at which Iive-aboard vessels are permitted, and any
private dock or mooring listed as the mooring site of any vessel to which a temporary
live-aboard permit has been issued, The unreasonable refusal of entry for the purpose
of determining compliance with this chapter shall be grounds for the revocation of any
such temporary live-aboard permit, without leave to reapply for one year from the
date of the refusal, or if the unreasonable refusal Is by the owner, operator, manager,
or person in charge of a marina facility, shall be grounds for the suspension of the
authorization to conduct live-aboard business and occupancy at such marina facility
until such time as an Inspection by the Harbormaster is conducted.
Section 114.07. Disabled vessels.
A disabled vessel which Is moored in excess of 72 hours shall be subject to

removal and storage by or nt the direction of the Harbormaster at the expense of the
owner or person or persons In charge of the vessel. A disabled vessel which constitutes
a hazard to navigation, by virtue of its condition or location, may be summarily
removed by or at the direction of the Harbormaster if the owner or person in charge of
the vessel is not able to move said vessel so that the hazard or danger no longer exists.
Section 114.08. Diving or jumping from City-owned docks, piers, or bridges
prohibited.
