CLEARWATER; AMENDING SECTION 26.38, CODE OF _.^ ORDINANCES, TO INCREASE THE MINIMUM PENSION PAYMENT FROM SEVENTY-FIVE DOLLARS ($75.00) TO THREE HUNDRED DOLLARS ($300.00) PER MONTH, WITH AN EXCEPTION FOR :. CERTAIN DEATH BENEFITS WHICH REMAINS UNCHANGED; a PROVIDING FOR A REFERENDUM ELECTION FOR THE PURPOSE `p .;r OF RATIFYING THE AMENDMENT; PROVIDING AN EFFECTIVE DATE. i• Y; WHEREAS, the employees pension plan for the City of Clearwater presently Y+ ' provides for a minimum pension payment of $75.00 per month, with an exception for certain death benefits; and WHEREAS, the City Commission of Clearwater deems It necessary and advisable ^i ' to increase the minimum pension payment to $300.00 per month, subject to the same exception, and to submit the amendment to the electors of the City for ratification; now, therefore, - BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 26.38, Code of Ordinances, is amended to read: Sec. 26.38. Same-Minimum. The sum of three hundred dollars ($300.00) seventy-Ave dellars 475-.99} per month Is hereby established as the minimum pension under this article, and any r, employee or employee's widow or widower entitled to a pension shall be entitled to a pension of not less than three hundred dollars ($300.00) seventy-'five dollers (-$75.9} per month; provided, however, that a widow or widower receiving fifty (50) percent of an employee's pension under section 26.36 shall receive only the fifty (50) percent of the employee's pension as provided b that section as herein set edt; instead of the . minimum pension provided by this section of seventy-five dollars (476;08}per month. Section 2. This amendment shall take effect upon the ratification thereof by a .i majority of the qualified electors of the City voting In a general election or In a special election called for such purpose upon the following ballot question: ' REFERENDUM QUESTION NO. The referendum question set forth in Section 2 of this ordinance shall be submitted to the electors of the City at a special election to be held concurrently with the general presidential election on November 8, 1988, except that the City Commission may by resolution call a special election to be held on a different date if necessary. Section 4. This ordinance shall take effect immediately upon adoption, except that Section 1 shall take effect only upon ratification by the electors of the City as provided herein.
