AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO TRAFFIC SAFETY; CREATING SECTION 120.189
CODE OF ORDINANCES, TO PROHIBIT STANDING OR WALKING
ON THE PAVED PORTION OR IN CERTAIN UNPAVED PORTIONS
OF ANY PUBLIC STREET RIGHT-OF-WAY FOR THE PURPOSE OF
SOLICITING OR COLLECTING DONATIONS OF MONEY OR
PROPERTY OF ANY KIND FROM THE OCCUPANT OF ANY
MOTOR VEHICLE, OR SOLICITING THE PURCHASE OF OR
SELLING PROPERTY OR SERVICES BY OR TO THE OCCUPANT OF
ANY MOTOR VEHICLE; PROVIDING DEFINITIONS; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of Clearwater finds and declares that the
solicitation or collection of donations of money or property from the occupants of
motor vehicles being operated upon the public streets, and the solicitation of the v
purchase of, or selling, property or services of any nature by or to the occupants of
such motor vehicles, by persons who stand or walk on the paved portion or certain
unpaved portions of public street rights-of-way constitutes a danger to public health
and safety and impedes the flow of traffic on the public streets; and
WHEREAS, the City Commission finds that the prohibition of such practices is
reasonable and necessary to protect the public health, safety, and welfare of the
community;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Section 120.18, Code of Ordinances, Is created to read:
Sec. 120.18. Soliciting, collecting, etc,, upon streets.
(a) No person shall stand or walk on the paved portion, or upon any unpaved
portion between the right-of-way boundary lines, of the right-of-way of any public
street within the jurisdiction of the city for any of the following purposes:
(1) Soliciting donations of money or of property of any kind for
charitable, religious, educational, benevolent or any other purposes from the occupant
of any motor vehicle being operated upon a public street within the jurisdiction of the
city.
(2) Collecting donations of money or of property of any kind for
charitable, religious, educational, benevolent or any other purposes from the occupant
of any motor vehicle being operated upon a public street within the jurisdiction of the
city.
(3) Soliciting the purchase of property or of services of any nature
whatsoever by the occupant of any motor vehicle being operated upon a public street
within the jurisdiction of the city.

(4) Selling property or services of any nature whatsoever to the occupant
of any motor vehicle being operated upon a public street within the jurisdiction of the
city.
(b) For the purposes of this section:
(1) "Paved" means improved for motor vehicular, bicycle or pedestrian
traffic. The term includes improved roadways, bicycle paths and sidewalks,
(2) "Right-of-way boundary lines" means the perimeter of the right-of-
way of a street. At any location where curbs, sidewalks or bicycle paths, or any
combination thereof, have been installed, it shall be presumed that the curb or the
outer edge of the sidewalk or bicycle path, whichever is most distant from the center
line of the street, Ls on the perimeter of the right-of-way.
(3) "Street" means a street, road or highway or other way, however
designated, upon which the public has the right to travel.
Section 2. This ordinance shall take effect immediately upon adoption.
