ORDINANCE 4529-87
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE LAND DEVELOPMENT CODE; AMENDING
SECTIONS 135.112 AND 135.116, CODE OF ORDINANCES,
RELATING TO THE RESORT COMMERCIAL 'TWENTY-FOUR" AND
RESORT COMMERCIAL "TWENTY EIGHT" DISTRICTS,
RESPECTIVELY, TO LIMIT THE LOCATION OF ALL ALCOHOLIC
BEVERAGE SALES IN SUCH DISTRICTS, WHETHER FOR
CONSUMPTION ON THE PREMISES OR BY PACKAGE SALES, TO
CERTAIN KINDS OF ESTABLISHMENTS; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF CLEARWATER, FLORIDA:
Section 1. Sections 135.112 and 135.118, Code of Ordinances, are amended,to
read:
See. 135.112. Use limitations.
(a) Multiple-family dwellings shall be governed by the dimensional and
numerical requirements of the Multiple-Family Residential 'Twenty-four" District
contained in section 135.063 of this chapter.
(b) All alcoholic beverage sales shall comply with the terms contained in
chapter 72 and in 186; section 136.024. Furthermore, all alcoholic beverage sales for
with consumption on the premises shall be located only within a hotel or motel in
conjunction with a 4-COPS license or within a restaurant deriving 51 ercent or more
of its gross revenue from the sale of food and nonalcoholic beverages. Package sales
of alcoholic beverages shall be located only within a hotel in conjunction with a 4-
COPS license or restaurant.
(c) Recreational vehicle parks shall comply with all terms contained in chapter
186; section 136.021.
(d) Marina facilities shall be located only on waterfront property where such
waterfront has been duly approved for use as a commercial marina in conjunction with
all terms contained In this development code.
(e) Accessory uses shall comply with all terms contained in chapter 136;
section 136.006.
(f) All uses, whether permitted, conditional or nonconforming, shall be
conducted in consonance with the use standards contained In chapter 136; section
136.005.
Sec. 135.118. Use limitations.
(a) Multiple-family dwellings shall be governed by the dimensional and

Section 3. This ordinance shall not be construed to apply to alcoholic beverage
sal-1-.establishments existing in the CR-24 and CR-28 districts as of the effective date
of the ordinance, or for which a conditional use approval application was filed with the
City on or before the effective date of the ordinance.
