ORDINANCE NO. 9509-87
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A PORTION OF KENTUCKY AVENUE LYING SOUTH
OF LOTS 6 AND 7, BLOCK 2, AND NORTH OF LOTS 4 AND 5,
BLOCK 3, BAY VIEW CITY SUBDIVISION, PINELLAS COUNTY,
FLORIDA; PROVIDING AN EFFECTIVE DATE.
WHEREAS, it has been requested by Bayview Baptist Church, owner of certain
real property located In the City of Clearwater, Florida, that the City vacate a
certain right-of-way; and
WHEREAS, after proper public notice 'and public hearing thereon, the City
Commission finds that a portion of said right-of-way Is not necessary nor required for
municipal use and It is deemed to be to the best interest and advantage of the City and
the general public that the same be vacated; now therefore
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following:
A portion of Kentucky Avenue lying South of Lots 6 and 7, Block 2,
and North of Lots 4 and 5, Block 3, Bay View City Subdivision,
according to map or plat thereof as recorded in Plat Book 9, Page 43,
of the Public Records of Pinellas County, Florida,
be and the same Is hereby vacated, closed and released, and the City of Clearwater
hereby quitclaims and releases all of Its right, title and interest thereto to the persons,
firms or corporations entitled thereto by law, excepting that the City of Clearwater
hereby retains a 15-foot drainage and utility easement 7-1/2 feet each side of the
centerline of Kentucky Avenue over said described real property for the Installation
and maintenance of any and all public utilities thereon.
Section 2. The City Clerk is hereby directed to record this ordinance in the
Public Records of Pinellas County, Florida.
Section 3. This ordinance shall take effect immediately upon adoption.
