ORDINANCE NO. 4470-87
AN ORDINANCE OF T1IE CITY OF CLEARWATER, FLORIDA,
RELA'T'ING TO THE LAND DEVELOPMENT CODE; AMENDING
SEC'T'ION 130.025, CODE OF ORDINANCES, TO AMEND THE
SUPPLEMENTARY STANDARDS FOR CONDITIONAL USE
APPROVAL FOR ALCOHOLIC BEVERAGE SALES (BOTH
CONSUMPTION ON PREMISES AND PACKAGE SALES) WITH
RESPECT TO THE MINIMUM DISTANCE REQUIREMENTS;
ESTABL'iSHING PROCEDURES AND STANDARDS FOR
VARIANCES; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Paragraphs (1) and (2) of Subsection (c) of Section 136.025, Code of
Ordinances, are amended to read:
Sec. 136.025. Conditional use standards.
(c) Supplementary standards, by category of use. The following standard(s)
(which apply to'the Identified category of use) shall supplement the general standards
of use identified above and no conditional use shall be authorized unless determined to
meet all of the standards applicable thereto.
(1) Alcoholic beverage sales (consumption on premises) may be permitted
within the Commercial and Industrial Planned Development Districts, and the
Neighborhood Commercial, Beach Commercial, Resort Commercial "Twenty-four" and
"Twenty-eight," General Commercial, Highway Commercial, Commercial Center,
Urban Center, and Limited Industrial Districts, and also within the Public/Semipublic
District in conjunction with a lodge or private club, within the Open Space/Recreation
District in conjunction with a golf course, and within the Aquatic Lands-Coastal
District in conjunction with a commercial passenger vessel upon determination that:
a. The use shall be sufficiently distant from churches, schools, hospitals,
residences and like land uses so as to not adversely affect the use, enjoyment or value
of such properties but not less than 500 feet therefrom. Variances to the minimum
distance requirement may be approved b the City Commission where the Cit
Commission finds that an unnecessary hardship exists and that the rant of the
variance will not be Injurious to the community. Variances to other site and structure
re uirements may be approved b the Development Code Adjustment Board.
b. The use shall comply with all of the general standards contained in
preceding paragraph (b).
(2) Alcoholic beverage sales (package sales) may be permitted within the
Commercial Planned Development, Neighborhood Commercial, Beach Commercial,
Resort Commercial "Twenty-four" and "Twenty-eight," General Commercial, Highway

Section 2. In implementing this ordinance, the following rules shall apply:
(1) For any variance request to be heard by the City Commission, the City

Clerk shall accept the application therefor, and shall colle:et an application fee in the
amount of $125.00. The City Clerk shall schedule a public hearing thereon and shall
,•;: give notice of the public hearing in the same manner as for a variance request to be
heard by the Development Code Adjustment Board.
(2) In considering a variance request, the City Commission shall take into
consideration the criteria for variances from the Land Development Code as set forth
in Section 137.012(d), City Code.
(3) An action to approve a variance shall be by a motion approved by not less
than three members of the City Commission.
(4) In approving a variance, the City Commission may impose conditions and
restrictions as described in Section 137.012(e), City Code.
(5) The sequence of events in processing an application for conditional use
approval for alcoholic beverage sales shall be:
(a) To the Planning and Zoning Board for a decision on the conditional use
k application, which may be made subject to obtaining any necessary variances;
(b) To the Development Code Adjustment Board for any necessary variances
other than to the minimum distance requirement; and
(c) To the City Commission for a variance from the minimum distance

requirement, if necessary.
(G) A decision by the City Commission on a variance request shall not be
subject to review by a hearing officer, but shall be deemed the final decision of the

City and subject to judicial review by common-law certiorari in the circuit court of
Pinellas County.
(7) In measuring the minimum distance, the measurement shall be taken In a
straight line from the nearest portion of the building or portion thereof where the use

is to be located to the nearest point on the boundary line of the property of a church,

school, hospital or residential zone.
i (8) This ordinance shall not apply to any established alcoholic beverage sales

use or to any application for conditional approval of an alcoholic beverage sales use
? filed with the City on or before September 3, 1987.
Section 3. This ordinance shall take effect immediately upon adoption,
