WHEREAS, there are many types of fire and security alarm systems presently In
use within the City of Clearwater and within the City's Fire District; and
WHEREAS, many of the fire and security alarm systems are causing the dispatch
,.,,. of fire and police units to the scenes of numerous false alarms; and
WHEREAS, such false alarms result In a substantial misuse and abuse of the time
and resources of the City's Fire and Police Departments, causing such time and
resources to be out of service when a true need or emergency situation may exist; and
r' WHEREAS, the current high number of false alarm incidents are deemed to
constitute a threat to the safety and welfare of the people and an Impediment to
effective fire and police protection;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 11. Article III of Chapter 93, Code of Ordinances, is created to read:
CHAPTER 93. FIRE PREVENTION AND PROTECTION
ARTICLE M. FIRE ALARMS AND SECURITY ALARMS
Section 93.30. Definitions. For the purpose of this article, the following terms

are defined to mean:
(1) "Alarm system" means any mechanical, electrical, or radio-controlled device
which is designed to be used for the detection of fire within, or any unauthorized entry
into, a building or structure or portion thereof, or for alerting others of the
Y commission of an unlawful act within a building or structure or portion thereof, and
which emits a sound or transmits a signal or message when activated. The term does
' not include alarm systems installed in motor vehicles or smoke detectors installed in
single-family or two family structures, nor does the term include alarm systems
installed in structures used by governmental agencies for public purposes.
f (2) "Alarm user" means the person in control of the premises wherein an alarm
system Is maintained.

representatives of either.
(5) "False alarm" means the activation of an alarm system through mechanical
failure, malfunction, improper installation, or the negligent or intentional misuse by
the alarm user or an employee, servant or agent of an alarm user, or any other
activation of the alarm system not caused by fire, smoke, heat, forced entry or
attempted forced entry, robbery or attempted robbery, which activation requires a
police or fire response. The term does not include the activation of an alarm system
caused by conditions which are clearly beyond the control of the alarm user.
(6) "Premises" means any building or structure or portion thereof protected by

(3) "Automatic telephone dialing device or digital alarm communicator alarm
system" means an alarm system which Is activated by a signal or message and which
automatically sends a prerecorded voice message or coded signal by microwave,
telephone lines, or other mode of transmittal directly to the Pinellas County 911 line
or directly to the police or fire department, Indicating the existence of an emergency
situation that the alarm system is designed to detect.
(4) "Enforcement official" means the police chief, fire chief or designated

an alarm system. In the case of two or more buildings or structures or portions
thereof on the same property under the same ownership protected by alarm systems
which are not connected to a single control system, each building or structure or
portion thereof shallbe deemed to be separate and distinct premises.
(7) "From the same premises" means at the same building or structure or
portion thereof protected by an alarm system, without regard to alterations thereto, if
the identity of the alarm user has not materially changed since the last false alarm
report. For example, but without limiting the meaning of this definition, a bona-fide
sale of the premises or the business therein to a third party, or the replacement of a
tenant by a different tenant, shall be deemed'a material change of the identity of the
alarm user.
Section 93.31. Requirements for Alarm Systems.
(1) It is hereby found and determined that three or more false alarms from the
same premises In any one-year period is excessive and constitutes a public nuisance.
(2) It shall be a violation for any person to install or continue to use a faulty
alarm system, or to negligently maintain an alarm system, in such a manner that the
alarm system generates an excessive number of false alarms. For the purpose of this
subsection, there shall be a rebuttable presumption that a violation has occurred if

three or more false alarms are generated from the same premises during any one-year
period. Each occurrence of a false alarm after three false alarms In any one-year
period at the same promises shall constitute a separate violation. In prosecuting a
case under this section, it shall be immaterial whether false alarms are generated by a
fault In an alarm system, by the negligent maintenance of an alarm system, or some
combination thereof.
(3) Notwithstanding, subsection (1) and (2), an alarm user shall not be charged

with any false alarm for which the alarm user presents evidence of a bona-fide}
attempt by a licensed alarm company, after the false alarm occurs, to Identify and
correct any defect of design or Installation of the alarm system which is identifiable :`lY
as the cause of the false alarm. The alarm user shall notify the enforcement official rqa+
promptly following each such bona-fide attempt to take corrective action, and the
enforcement official shall determine either that the false alarm shall not be charged
to the alarm user or that the attempt to take corrective action was not bona-fide.
This subsection shall not be available to excuse any false alarm for which the report
has been determined valid by the Code Enforcement Board as described in Section
93.33(2) after the board has made its determination and concluded Its hearing,
(4) A written notification shall be submitted by the alarm user for each newly
installed, reinstalled or transferred alarm system on forms to be provided by the City,
setting forth the name of the alarm user, address of the premises, name and address of
the alarm company which installed or reinstalled the alarm system, and the names and
telephone numbers of at least two persons to be notified in the event of an alarm
activation. For fire alarms, the notification shall be submitted to the Clearwater Fire
Department; for security alarms, to the Clearwater Police Department. The
notification shall be submitted not later than 10 days after installation, reinstallation
or transfer of the alarm system.
Section 93.32. Response to False Alarms; Notice.
(1) Whenever an alarm system Is activated within the City's jurisdiction, thereby
requiring a response to the premises by the police department or fire department, the
enforcement official on the scene shall Inspect the premises, investigate the cause for
the alarm, and determine whether or not the response was in fact required. If the
enforcement official determines the alarm to be false, the enforcement official shall
complete a false alarm report, and a notification of the false alarm report shall be
mailed or hand delivered to the alarm user, at the address of the premises, and a copy
thereof to the owner of the premises if the alarm user is not the owner.

<x; , (2) The enforcement official shall have the right to inspect any alarm system to

determine whether the alarm system is being used in conformance with the terms of
`'this article.
Section 93.33. Enforcement and Hearin Procedures.
? (1) The Clearwater Code Enforcement Board shall have the authority to conduct

`" hearings and issue appropriate orders necessary for the enforcement of this article.
(2) In each case brought to the board under this article, the board shall
determine whether or not the false alarm reports are valid or invalid, and If three or
more false alarm reports having occurred within a twelve-month period from the same
remises are determined valid the board may then order corrective action to be taken

within a time determined by the board to be reasonable. The board shall also include

in its order a schedule of fines as set forth In Section 93.34 to be imposed upon the

occurrence of any false alarm within one year after the date set by the board to take
corrective action.
(3) In making Its determination in any case, the board shall follow the
?w procedures and may exercise the powers vested in the board as set forth in Article V
of Chapter 22.
Section 93.34. Fine Schedule.
(1) Following a determination by the Clearwater Code Enforcement Board that

three or more valid false alarms have been generated from the same premises within
a one-year period, and upon a showing that one or more additional false alarms have
".`c? occurred within one year after the expiration of a reasonable time to take corrective
action, as determined by the board, the board shall impose a fine not less than the

minimum fines set forth In the following schedule for each such additional false alarm:

(2). A certified copy of an order imposing the fine or fines provided for herein
may be recorded in the public records of the county, and thereafter such order shall
constitute a lien against the land on which the violation exists or, if the violator does

not own the land, upon any other real or personal property owned by the violator, and
may be enforced In the same manner as a court judgment by the sheriffs of this state,
including levy against the personal property, but shall not be deemed to be otherwise
to a judgment of a court except for enforcement purposes.

(3) Any such lien which remains unpaid six months from the date of recording
shall be subject to foreclosure as described in Section 22.07.
Section 93.35. Automatic Telephone Dialing Device or Digital Alarm
Communicator Alarm System - Prohibited.
' It shall be unlawful to install or maintain an automatic telephone dialing device
or digital alarm communicator alarm system within the City or the City's fire district.
Section 93.36. Newly Installed Alarm Systems.
The provisions of this article shall not apply to any new installation of alarm
systems for the first thirty (30) days following completion of the installation.
Section 2. This ordinance shall take effect 30 days after adoption.
