AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO TRAFFIC AND MOTOR VEHICLES; CREATING SECTION 121.12, CODE OF ORDINANCES, TO PROVIDE THAT THE CONTINUING VIOLATION OF ANY OF THE PROVISIONS OF CHAPTER 121, CODE OF ORDINANCES, SHALL CONSTITUTE A SEPARATE OFFENSE FOR EACH HOUR THAT THE VIOLATION OCCURS, SUBJECT TO CERTAIN LIMITATIONS; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Section 121.12, Code of Ordinances, Is created to read; See. 121.12. Continuing violations; separate offenses. The continuing violation of any of the provisions of this chapter shall constitute a separate offense for each hour that the violation occurs. It shall not be necessary to observe the violation continuously for each hour, but citations or notices shall be issued not less than one hour apart. However, not more than six citations or notices shall be issued for the same violation by the same vehicle at the same location In any 24-hour period. This section shall not be construed as limiting the authority of the chief of police or any police officer of the city to impound and remove any motor vehicle pursuant to Article II of this chapter. Section 2. This ordinance shall take effect Immediately upon adoption.
