RELATING -TO ALCOHOLIC BEVERAGES; CREATING SECTIONS
72.11 THROUGH 72.211 CODE OF ORDINANCES, TO PROVIDE
UNIFORM OPERATIONAL REGULATIONS FOR ALL
ESTABLISHMENTS IN THE CITY DEALING DIRECTLY OR
INDIRECTLY WITH THE SALE OR CONSUMPTION OF ALCOHOLIC
BEVERAGES; AMENDING - SECTION 136.024, CODE OF
ORDINANCES, RELATING TO ZONING AND SEPARATION
REQUIREMENTS FOR ALCOHOLIC BEVERAGE SALES;
REPEALING SECTION 136.025(c)(1) and (2), AND SECTIONS 72.01
THROUGH 72.10, CODE OF ORDINANCES, RELATING TO
ALCOHOLIC BEVERAGES; PROVIDING AN EFFECTIVE DATE.

CLEARWATER, FLORIDA:
Section 1. Sections 72.11 through 72.18, Code of Ordinances, are created to
read:

Sec. 72.11. Purpose.
This chapter Is enacted to provide uniform operational regulations pursuant to
the authority reserved to the city by Section 562.45(2), F.S., for all establishments in
the city dealing directly or indirectly with the sale or consumption of alcoholic
beverages.
Sec. 72.12. Definitions.
As used in this chapter:
(a) "Alcoholic beverage establishment" or "establishment" means any business
licensed or required to be licensed by the State of Florida to sell any alcoholic
beverage.'
(b) "Bottle club" means an establishment at v " •'? alcoholic beverages are.
served during any of the hours of closing as established in Section 72.15 in connection
with the sale of a nonalcoholic beverage, ice, the service of mixing the drink, or other
thing of value.
(c) "Premises" means that portion of a parcel of property occupied by an '
alcoholic beverage establishment. With respect to any business establishment engaged
in a business primarily other than the sale or consumption of alcoholic beverages and
which maintains a separate section within such business establishment for the sale or
consumption of alcoholic beverages, the term shall be limited to such separate section.
(d) "Sell" or "dispense" means to transfer or offer to transfer for a
consideration, or in connection with or as a part of a transfer of other property or a
service for a consideration.
(e) "State" means the State of Florida.

See. 72.13. Alcoholic beverage license required,
t All alcoholic beverage establishments In the city shall be licensed in accordance
with the applicable requirements of Florida law and of Pinellas County. For the
purpose of obtaining a Florida license, the owner of the establishment shall obtain a
statement of zoning compliance from the development code administrator following
conditional use approval.
Sec. 72.14. Other city requirements.
(a) In addition to the regulations contained in this chapter, the conditional use
approval requirements and the separation requirements set forth in Section 136.024
shall apply to alcoholic beverage establishments.
(b) Any person engaging in any business selling alcoholic beverages shall obtain a

E certificate of occupancy/use for the premises, and shall be subject to the occupational
licensing requirements of the city as set forth in chapter 71 to the extent that such
person is engaged in the business of selling nonalcoholic merchandise, food and
services.

Seca 72.15. Closing hours.
;
(a) There are hereby established the following hours of closing for all alcoholic
. ' beverage establishments:
i
(1). Alcoholic beverage establishments shall not sell any alcoholic
beverage between the hours of 2:00 a.m. and 8:00 a.m. on any day of the week except
Sunday.
(2) Alcoholic beverage establishments shall not sell any alcoholic
beverage between the hours of 2:00 a.m. and 1:00 p.m. on any Sunday.
(b) Additional limitations:
(1) Alcoholic beverage establishments licensed for the sale of beer, wine
or liquor for consumption off the premises only shall not sell:
a. Beer or wine between the hours of 12:00 midnight and 8:00 a.m.
each weekday, and between the hours of 12:00 midnight Saturday and 1:00 p.m. on
Sunday; or
b. Liquor between the hours of 12:00 midnight and 8:00 a.m. each
weekday, and between the hours of 12:00 midnight Saturday and 8:00 a.m. Monday.
(2) Establishments licensed to sell alcoholic beverages for consumption ,
on the premises shall not sell liquor between the hours of 1:00 p.m. Sundays and 8:00
a.m. Mondays for consumption off the premises. However, such establishments may
sell packaged beer or wine during such hours for consumption off the premises.

(e) The planning and zoning board or the city commission, as a condition of
approval of a conditional use application or a variance from the separation'
requirements, respectively, may Impose earlier closing hours or later opening hours, or
both, if such condition is deemed by the board or commission to be reasonably related
to one or more of the criteria required to be met for such conditional use approval or
variance. In such cases, the violation of the condition shall be deemed a violation of
this section, and the citation or notice of violation shall include a reference to this
subsection (c).
See. 72.16. Special events.
The City Commission may authorize the sale of alcoholic beverages at special
events for which a permit has been issued by the City Manager in accordance with the
provisions of Chapter 116. However, no alcoholic beverages shah be sold or consumed
in any location where prohibited under the terms of Section 72.17.
See. 72.17. Prohibited acts.
(a) It shall be a violation for any person licensed to operate an alcoholic

beverage establishment, or employed by or acting as an agent of, any such
establishment, and who sells or causes to be sold any alcoholic beverage, to permit
such beverage to be consumed on any property under the control, directly or
indirectly, of the licensee, except within the area of the premises which is licensed for
such sales and consumption.

(b) It shall be a violation for any person to consume any alcoholic beverage on
any property under the control, directly or indirectly, of the licensee, except within
the area of the premises which is licensed for such sales and consumption.
(c) It shall be a violation for any person to consume any alcoholic beverage off
a licensed premises and within five hundred (500) feet thereof, except within enclosed
buildings or on property occupied by residential structures. The distance set forth
herein shall be measured by following a straight line from that portion of any structure
licensed for the sale of alcoholic beverages nearest to the place of violation of this
subsection.
(d) It shall be a violation for any person to sell or consume any alcoholic
beverage, or to possess any opened or unsealed container containing an alcoholic
beverage, within the following places:
(1) On any public beach.
(2) On or in any public street, alley, sidewalk, parking lot or right-of-way,
including but not limited to unimproved public street rights-of-way
terminating at a body of navigable water.

(3) In any public park. For the purposes of this subsection, the term "park"
i. shall mean all parks and athletic fields, and all grounds used by the city for
park or playground purposes, excluding Jack Russell Stadium and the
Clearwater Country Club Golf Course when the sale or consumption of
alcoholic beverages has been authorized by the terms of any lease or other
ri
agreement approved by the City Commission.
(4) In any public building, except in any portion of a public building when
> F rented to private parties. This prohibition shall not apply to the

Performing Arts Center and Theater.
is (5) A person found in or upon any motor vehicle or any other form of
conveyance which is located on or in any place described herein shall be
deemed to be on or in such place.
' (e) There shall be no bottle clubs.

Sec, 72.18. Inspection and enforcement.
z The chief 'of police or his designated representative shall be authorized to
inspect each establishment to determine that all provisions of this chapter are adhered
to. Where the chief of police or his representative is refused entry, an administrative
search warrant may be obtained pursuant to Section 933.21, F.S.
See. 7219. Special conditions, suspension or revocation of conditional use
approvals.
(a) A conditional use approval for the sale of alcoholic beverages in the city Is
deemed to be in the nature of a license which is personal to the applicant, not
transferable without the consent of the city, and not a property right which runs with
the land. The consent of the city for a transfer shall be in the form of a conditional
use approval for a change of business ownership or, in cases where an existing
alcoholic beverage sales use at a different location is discontinued, for a new alcoholic
beverage sales use.
' (b) For the purposes of this section;
(l} "Approval" shall mean a conditional use approval for the sale of alcoholic
beverages within the city. Every alcoholic beverage establishment lawfully in
existence within the city as of January 21, 1988, the date of adoption of Ordinance
4420-87, shall be deemed to have such approval, Including but not limited to

,. establishments which predate the adoption of the land development code,

or other sentence, and regardless of whether or not the court -withholds Its formal
adjudication of guilt,
(3) "Holder of the approval" or "holder" shall mean the person having the right
to operate an alcoholic beverage establishment within the city. The term shall also
include any off leer or director or partner, if the holder Is a corporation or partnership,
and any employee or agent of the holder if the employee or agent Is convicted of a
crime or found to have violated an ordinance or condition described in subsection (c).
(c) An approval shall be subject to special conditions, suspension or revocation
as described herein In the event that the holder of the approval is:
(1) Convicted of any felony as the result of conduct on or off the premises;
(2) Convicted of any misdemeanor violation of any law relating to assault and
battery, weapons and firearms, prostitution, lewdness or indecent exposure, fraudulent
practices, public nuisances, obstructing justice, obscene literature, gambling, drug
abuse prevention and control, or offenses concerning racketeering and illegal debts,
including any conduct which is unlawful pursuant to Chapters 784, 790, 796, 800, 817,
823, 643, 847, 849, 893 or 895, Florida Statutes, as the same may be amended from
time to time, including but not limited to conviction for attempt or conspiracy to
commit any of the foregoing, as the result of conduct on the premises;
(3) Convicted of a violation of any ordinance of the city relating to any
conduct on the premises of a kind described in paragraph (2) of this subsection, or
relating to the subjects of disorderly conduct or noise pursuant to Sections 96,01, 96.02
or 150.14, City Code of Ordinances.
(4) Found by the code enforcement board of the city to have violated any
ordinance of the city applicable to the alcoholic beverage establishment or the
operation thereof; or
(5) Found by the city commission, after a hearing for which the holder has
been given notice and an opportunity to appear and participate, to have violated any
ordinance of the city relating to the standards or criteria for conditional use
approvals, including but not necessarily limited to false or incomplete information
provided by the applicant of a material nature, or to have violated any condition
imposed by ordinance or by the planning and zoning board at the time of conditional
use approval, or to have violated any condition previously imposed by the city
commission pursuant to this section. The hearing described in this paragraph shall be
combined with the hearing required by subsection (d).

(d) In any case in which a conviction or violation described in subsection (c) is
alleged to have occurred, the city commission may take one of the following actions
upon the conclusion of a hearing for which the holder has been given notice and an
opportunity to appear and participate:
(1) Continue the approval subject to such conditions as shall be deemed
reasonably necessary by the city commission to assure compliance with applicable laws
and ordinances;
(2) Suspend the approval for a period of time to be determined by the city
commission, but not to exceed six months; or
(3) Revoke the approval.
(e) The hearings required by this section shall be conducted by the city
commission during any regular meeting or special meeting called for such purpose. At
such hearing, the holder shall have an opportunity to present evidence on his or her
behalf, to cross-examine adverse witnesses, to be represented by counsel, and to show
cause why the approval should not be continued subject to conditions, suspended, or
revoked.
(f) The decision of the city commission shall be deemed a final administrative
agency decision, subject to judicial review by common-law certiorari in the circuit
court for Pinellas County.
Sec. 72.20. Inspection of records.
Each establishment which sells alcoholic beverages for consumption on the
premises in conjunction with the sale of food, and which is licensed by the State under
a license which requires that a specified percentage of gross revenue of the
establishment be derived from the sale of food and nonalcoholic beverages, shall keep
and maintain all records required by Florida law and shall permit the inspection of
such records by designated employees or agents of the city, on the premises or at a
designated place which has been approved by the Florida Division of Alcoholic
Beverages and Tobacco for such purpose, during reasonable hours.
See. 72.21. Severability.
This ordinance is declared severable. Should any provision hereof be declared
invalid for any reason, the remaining provisions shall continue in full force and effect
as if the invalid provision had not been included.

(b) Applicability. Prior Fallowing the adept#on of this development eedei prier i

area of an alcoholic beverage sales use to include floor area or land area not

its gross revenue from the sale of food and non-alcoholic beverages , within
254 feet of the proposed establishment) and showing the actual distance
from the ro osed establishment to each church school or residential zone
depleted thereon measured as described in subsection (d)(3).
(d) Separation requirements.
(1) No alcoholic beverage establishment shall be permitted within 300 feet of
any church, school or residential zone, except as provided In Paragraph (2) of this

(3)_ For tho purpose of this subsection (d)= the distance shall be measured by
following a straight line from the nearest point of any structure or -portion thereof
occupied by an alcoholic beverage establishment, including but not limited to any
outdoor area used for alcoholic beverage consumption, to the nearest point on the
boundary of the property of a mse or zone described in
paragraph (1) of subsection (d)

a (4) Notwithstanding the separation requirements of this subsection (d), an
existing alcoholic be;reraLe establishment shalt not be deemed illegal or nonconforming
for violating the separation requirements if the location of the establishment was
`- specifically approved by an ordinance adopted by the city commission pursuant to the
r• designation procedures set forth In former Section 72.01 b a variance anted b the
city commission pursuant to Ordinance 4470-87, by a decision of the planning and
zoning board prior to September 3, 1987, or by a subsequent hearing officer's decision.
However, an such establishment may not expand-its floor area or seating capacity
unless the owner can demonstrate compliance with the separation requirements.
(5) An otherwise conforming alcoholic beverage establishment shall not be
deemed illegal or nonconforming for violatinL the se2aration requirements because of
the establishment of a use or zone described in paragraph (1) of subsection (d) above
after the approval of the alcoholic beverage establishment.
(6) Variances from the separation requirements of this subsection may be
approved by the city commission where the city commission finds that an unnecessary
hardship exists and that the Eant of the variance will not be Injurious to the
community. Variances to other site and structure requirements may be a22roved by
the development code adjustment board. The following rules shall apply to requests
for variances from the separation requirements:
a. The city clerk shall accept the application therefor, and shall collect an

application fee in an amount as deterinined b the city commission b resolution. The
city clerk shall schedule a public hearing thereon and shall give notice of the public
gearing in the same manner as for a variance request to be heard by the development
code adjustment board.
b. In considering a variance request, the City Commission shall take into
consideration the criteria for variances from the land develo ment code as set forth in
Section 137.012(d).
C. An action to approve a variance shall be by a motion approved by not less
than three members of the city commission.

subject'to review by a hearing officer, but shall be deemed the final decision of the
city and subject to judicial review by _common-law certiorari in the circuit court of

Each establishment which is licensed b the State for on-premises consumption
and package sales as a 1-COP, 2-COP or 4-COP establishment shall contain a
minimum of 50 indoor seats and shall have a minimum interior floor area of 1,000
square feet. Any such establishment which adjoins a residential zone shall be
separated from the residential zone b a buffer adequate to reduce the assn a of
light, noise and pedestrian traffic, such buffer to be approved by the Planning and
Zoning Board at the time of conditional use approval.
