AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO LOT CLEARING; AMENDING SECTIONS 95.01,
95.04, 95.071 95.08 AND 05.11, CODE OF ORDINANCES, TO
PROVIDE FOR ADMINIS'T'RATIVE REVIEW OF LOT CLEARING
NOTICES BY THE CODE ENFORCEMENT BOARD; ABOLISHING
THE LOT CLEARING BOARD; REPEALING SECTIONS 95.09, 05.10
AND 95.15, CODE OF ORDINANCES, RELATING TO THE LOT
CLEARING BOARD AND TO FEES; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Commission determines that it is advisable and appropriate
to amend the lot clearing ordinance of the City in order to utilize the existing Code
Enforement Board, rather than the Lot Clearing Board, as a forum for property owners
who elect to protest notices Issued pursuant to the ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Sections 95.01, 95.04, 95.07, 95.08 and 95.11, Code of Ordinances are
amended to read:
See. 95.01. Authority; short title.
(a) Pursuant to the authority granted by Article VIII, Section 2(b), Florida
Constitution, and as'ir'nnplcmented by the ieg4slature under F.S. 5 166.021, known as the
"Municipal Home Rule Powers Act," the city commission hereby establishes these rules
and a board of dewipated eAy o ieial's appointed by the eity manager to oversee the
procedures whereby property; 4ne'luding parkways; located in the fneerporated area of
the city may be cleared of excessive growth of weeds or other plants or cleared of
excessive accumulation of plant material or of debris, trash, junk or other noxious
materials, and abandoned property.
(b) This article shall be known as the "City of Clearwater Lot Clearing
Ordinance." t
See. 95.04. Prohibitions; removal of abandoned property.
(a) No person shall permit the excessive growth or accumulation of weeds or n=
other similar plant materials, or the accumulation of debris, which is unattended and
which creates a haven and breeding place for snakes, rats, rodents or other vermin of
similar kind and character or which furnishes a breeding place for mosquitoes or which x, +*'

designated horoin, the property owner shall cut the grass In such a manner that the
grass as mowed does not extend over the sidewalk, bicylc3 pnth, eurbllne or edge of
pavement of an improved right-of-way by more than four (4) Inches.
(c) Any owner or lessee of developed property who removes or has removed
from the property any hedges, tree trimmings, boxes or other household Items, shall
have, the same out Into lengths no loner than four (4) feet and deposited at the edge
of the street in front of the property for regider pick up by city sanitation trucks of
+he e4y on their regular days of pick up. Should the city refuse to pick Up Hetisehe4d
items such as but not limited to mattresses, pieces of furniture, or old refrigerators,
which are too large to place Into city sanitation trucks, it will be the responsibility of
the property owner or lessee to have an eateWe eampany or organ jatieri remove said
items within ten (10) days or such owner or lessee will be issued a citation by the
sanitation division of the eity for allowing such material to cause a nuisance to the
general neighborhood. If the property owner or lessee contracts for the services of to
- Have a commercial landscaper, tree surgeon or others in the business of clearing or
improving property, the contractor will be responsible for the removal of all debris and
cuttings. Failure to remove the debris and cuttings will result in a citation being
Issued to the violator. Any person violating the provisions of this subparagraph shall
be subject to a fine of not more than two one hundred fifty dollars ($250.00 $198:09).
(d) Pursuant to F.S. S 705.16(4)(a), (b), the provisions of such section are
hereby adopted by reference and shall constitute the provisions that will apply In the
removal of abandoned property from public and private property, except rights-of-
way, in the city. The term "abandoned property" shall have that meaning as set forth
in F.S. S 705.16(2)(b). The terra "debris" as defined in section 95.03 and the term
"abandoned property" as defined herein shall be construed as being mutually exclusive.
In utilizing the procedure set out in F.S. S 705.16(4)(a), (b), such required notice shall
contain a provision providing that a pre-taking hearing will be conducted before the
code enforcement ei+y }et eleari"g board and setting forth the place and time of such
hearing within €4ve 04 days of the remevai 4me provided in -the not-44e. Such provision
shall also advise the owner or person interested in' the property proposed to be
removed that such person may appear at such hearing and contest the decision that
such property is abandoned.
. The procedure incorporated by this subparagraph to be utilized in removing
abandoned property shall be applied separately from the procedure otherwise set out in
this chapter for the clearance of lots.

The sanitation superintendent or his designee shall have the responsibility of
enforcing the provisions of F.S. 5 705.16.
Sec. 95.07. Notice of violation and hearing.
(1) Upon receipt of a complaint that property is in violation of this chapter and
r
upon completion of the field investigation by the sanitation division and determination'
that a violation exists, the property will be posted with a notice advising of the
existence and nature of the violation and requesting compliance on or before a date
certain which shall be the day before the date of a regularly scheduled meeting of the
code enforcement board but which shall be not less than twenty-one (21) whin
fifteen {454 days after the date of posting. A copy of the notice teller of demand will
be sent to the property owner by fhet eless mall on or before the date of posting, or by
personal service within fourteen (14) days after the date of ostin .
(2) The notice shall request that the owner cause the violation to be remedied on
or before the dates ecified in the notice as the date for compliance, or authorize the
city to enter the property and have such work done on behalf of the owner at cost to
the owner, iincluding the administrative costs authorized b Section 95.08 which shall
become a lien against the property until aid. The notice shall advise the owner of the
date and time when the owner, or his agent or re resentative may appear before the
code enforcement board to show the board that the condition described in the notice
does not exist or to show good cause why the condition should not be remedied by the
eity at the expense of the owner. The' notice shall also state that if the owner falls to
appear before. the code enforcement board at the designated time to protest such
notice In, person orb representation, and has failed to take action to remedy_ the
condition before the datespecified for compliance, then the owner shall be deemed to
have authorized the city manager or a ei!y employee designated by the city manager

(3) For the purpose of giving notice to the owner, the name and address of the

used. Notice shall be deemed given when personally served upon the owner, or an
owner if more than one, or when deposited in the U. S. mail with postage paid. The
refusal of an owner to accept delive of notice shell not be deemed a failure to give

Sec. 95.08. Hearing before the code enforcement lot clearing board andfor
appeal to the city eonnmissien.
The code enforcement let elearing board shall provide each sueh property owner
receiving notice of a violation who elects to protest the notice and whoa ears on the
date and at the time designated in the notice an opportunity to appear and be heard by
the beard and to present evidence or testimony that the sub}eet property is net in
violation of this ehapter. Upon hearing all testimony and evidence concerning the
alleged violation, the board shall determine whether or not the condition as described
in the notice to the owner exists and if it is determined to exist whether the
condition should be remedied at the a ease of the owner, owner has vielated the
previsions eF this ehapter and shall inform the owner of its decision at the board
meeting. The feregeing proeess will apply to the hearktg held by the e4ty commission
should the property owner appeal the decision of the beard to the e4ty eemm4selere At
the hearing of the property owner before the eity eommissierr; the deeision of the eity
eemrnission will be final and binding.
(a) If the board determines that the condition as described in the notice to the
owner does not exist or that the condition should not be remedied at the expense of
the owner, for good cause shown, then the notice to the owner shall be deemed of no
further effect.
(b) If the board determines that the condition as described in the notice to the
owner does exist and should be remedied at the a ense of the owner, the owner shall
have ten (10) days from the date of the board's determination to remedy the condition
unless the boardspecifies a later date. Upon the failure of the owner to remedy such
condition within the time allowed the city manager or a city employee design ted b
the city manager for such urpose shall authorize the entry _upon the property and such
action as is necessary to remedy the condition without further notice to the owner.
The sit manager or the cit mans ergs designee may rant the owner an extension of
time not to exceed seven (7) days, upon request, and for good cause shown in which to
remedy the condition at the owner's expense.
(c) If action to remedy the condition is taken b the city, the actual costs of
such action plus administrative costs in the amount of $150.00 shall be owed b the
