AN ORDINANCE OF THE CITY OF CLEARWATER RELATING TO
NOISE; AMENDIN(I SECTIONS 96.01, 96.02 AND 96.04, CODE OF
ORDINANCES, PROIIIBITINa LOUD AND RAUCOUS NOISE;
PROVIDING FOR SEVEItABILITY; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA.
Section 1. Sections 66.01, 96.02 and 96.04, Code of Ordinances, are amended to
read:
Sec. 96,01. Prohibited generally.
It shall be unlawful for any person to willfully make, continue or cause to be
made or continued any loud and raucous noise, which term shall mean any sound which,
because of its volume level, duration and character, leud rinneeessary or unesaa-1
noise er any nelse with either annoys, disturbs, Injures or endangers the comfort,
repose; health, peace or safety of reasonable persons of ordinary sensibilities ethers
within the limits of the city. The term includes the kinds of noise generated by the
activities enumerated in Section 96.02, except as provided in Section 96.04. The term
shall be limited to loud and raucous noise heard upon the public streets, in any public

park, in any__school or public building or upon the grounds thereof while in use, in any
church or hospital or upon the rounds thereof while In use upon an parking lot open
to members of the public as invitees or licensees or in an occupied residential unit
which is not the source of the noise or u on the rounds thereof, and in an event from
a location not less than fifty (50) feet from the source of the noise measured in a
straight line from the radio loudspeaker, motor, horn or other noise source.
Sec. 96.02. Enumeration.
The following acts, as limited b Section 96.01 and subject to the exceptions
rovided in Section 96.04 among others, are declared to be up_he laud; disturbing and
unneeessary nuisances in violation of Section 96.01, this ehapter; but sueh enumeration
shall net be deemed to be exeleive; namely:
(1) Engines, whistle, pile drivers, etc.--Exhaust. The discharge into the open
air of the exhaust of any steam engine or stationary Internal combustion engine except
through a muffler or other device which will effectively prevent loud and raucous or
explesWe noises therefrom.
(2) Same--Pile drivers, etc. The operation between the hours of 6:00 -13:99
p.m. and 7;00 a.m. on any day eaeh weekday or at any time and ali day on Sunday, of

hoist or other appliance, the use of which is attended by loud and raucous or unusual,
noise.
(3) Same--Blowers. The operation of any ne se-ereating blower or power fan

or any internal combustion engine, the operation of which causes loud and raucous
noise, due to the explosion of operating gases or fluids; unless the noise from such
blower or fan is muffled or and such engine is equipped with a muffler device
sufficient to prevent loud and raucous deaden such noise.
(4) Horns, signaling devices, etc. The sounding of any horn whistle or other
audible signaling device on any automobile; metereyel•e or other vehicle so as to create
a loud and raucous noise. an any street or public place of the eity; except as a danger
warning; the creation of any unreasonably lead er harsh seand by means of any such
signaling device and the sounding of any such device far an unnecessary and
unreasonable period of time: The use of any signaling deviee except one operated by
hand or eleetrieity, the use of any her-a wh!914 or ether deviee operated by engine
exhaust and the use of any sueh stealing device when traffic 49 for any reason held up:
(5) Radios, amplifiers phonographs, etc. The using, operating or permitting to
be played, used or operated any radio, amplifier, reeeiving set, musical instrument,
phonograph or other maeh4ne er device for the producing or reproducing of sound in
such manner as to cause loud and raucous noise disturb the peace, quiet and comfort of
the neighboring inhabitants or at any tome with leader volume than 49 neeessary far the
convenient hearing for the person whe 49 in the Teem-,T vehicle or chamber 4n whieh
such maehine or deviee 49 operated and who 4s a vehmtary listener thereto: The
operation of any sueh set; instrurrrent; phenograph; machine or device between the

truck or other device or medium for amplifying sound shall be operated or permitted
to operate within the city for advertising purposes or to attract the attention of the

interferes with the workings of such Institution, or which disturbs or unduly annoys

(13) Reserved. Hawkersr peddlers; eter The shouting and erying of peddlers;
hawkers and vendors wlhieh disturbs the pewee and quiet of the neighberhoodr
(14) Noises to attract attention. The use of any drum or other instrument or
device to create a loud and raucous noise for the purpose of attraeting attention by
ereatien of noise to any per€ermanee show or sale.

Events for whieh a permit has been issued by the eity manager or his designee shall be
exempt from the time requirement set forth herein:

The term "loud and raucous noise" does not include noise or sound generated b
the following-
(a) Cries for emergency assistance and warnin calls. It is reeegnieed that
emergeney eenditions may warrant the operation of one er more of the engines or

Section 2. It is the intent of the City Commission that this ordinance be
construed to secure for the people freedom from unwanted loud and raucous noise as
described herein without violating any of the rights secured by the Constitution to the

people. In the event that any provision hereof should ever be determined invalid for
any reason, it is the intent of the City Commission that the remaining provisions
