AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO ANNEXATION; AMENDING SECTIONS 132.005 AND
132.007, CODE OF ORDINANCES, TO DELETE THE REQUIREMENT
THAT PROPERTY PROPOSED TO BE ANNEXED SHALL INCLUDE
ALL CONTIGUOUS PROPERTY UNDER ONE AND THE SAME
OWNERSHIP; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 132.005, Code of Ordinances, is amended to read:
Sec. 132.005. Requirements.
(a) Reserved. Property proposed to be annexed shell include all contiguous
property under one and the same ownership:
(b) Property to be annexed shall be consistent with the city's land use plan in

terms of the proposed category of land use. In the alternative, an acceptable
amendment to such plan shall be proposed, which amendment will be considered
concurrently with the annexation request. Also, Speeif'ieallyT the proposed zoning
district classification shall be consistent eo4nelde with the applicable category of the
land use plan for the area under consideration.
(c) All petitions to annex that contemplate Initiation of project development
(other than construction of one single-family or two--family dwelling) prior to the
effective date of annexation shall include all appropriate site p Lan plat-, plats, plat,
and engineering plans to be submitted to the city for review at the time the petition is
submitted. Such plans shall be reviewed by the -departments responsible for their
consideration to determine the for consistency of such plans with the applicable
standards of the city which will apply to the development upon transfer of jurisdiction
to the city. Consistency of such plans- with- applicable city standards shall be a
prerequisite for approval of an annexation petition. Following and; fallowing such
review, an annexation petition shall be approved, approved subject to modification or
conditions, or disapproved with the reason(s) for such disapproval noted. Subdivision
plats and site plans reviewed cinder this process shall contain the information required
ky identified in chapters 133 and 137; respeetively; of this development cede.
Requisite plans shall be subm*ted to and reviewed by the respeetive departments
responsible for their eensideratien +n. a form so as to enable determination that such
plans will be in eompHenee with eity requirements apes the completion of the
annexation process-.-
(d) Owners of property to be annexed shall be responsible for the payment of
impact fees to the city for those services to which the impact fees are attendant.
