ORDINANCE NO. 4288-86 "
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE LAND DEVELOPMENT CODE; REPEALING
SECTION 138.05, CODE OF ORDINANCES, WHICH PROVIDES
THAT ALL PROPERTY, WITH CERTAIN EXCEPTIONS, LOCATED
WITHIN THE CORPORATE LIMITS OF THE CI'T'Y SHALL BE
WITHIN THE FIRE DISTRICT; PROVIDING AN EFFECTIVE
'. DATE.
WHEREAS, the purpose of a fire district is to impose stringent
building construction requirements in order to control the risk of
conflagration; and
WHEREAS, because most of the City has been developed with low
density or medium density single family residential construction
and low rise non--residential construction there is little or no
likelihood of conflagration, and the construction requirements set
forth in the building code and life safety code for high rise or
large commercial structures are deemed sufficient;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Section 138.05, Code of ordinances, is hereby
repealed.
Section 2. This ordinance shall take effect immediately
upon adoption.
