ORDINANCE NO. 4278-86
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO NONCONFORMING SIGNS; AMENDING SECTION
134.015, CODE OF ORDINANCES, TO PROVIDE THAT THE
MESSAGE ON CERTAIN NONCONFORMING SIGNS MAY BE
CHANGED UNDER CERTAIN CIRCUMSTANCES; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER,,FLORIDA:
Section 1. Section 134.015, Code of Ordinances, Is amended to read:
See. 134.015. Nonconforming signs.
(a) No nonconforming sign ' may be constructed, reconstructed, altered,
renovated, relocated, replaced or otherwise changed after the effective date of this
chapter, unless such action brings the sign into conformance with the provisions of this
chapter, except to the extent permitted by subsection (b).
(b) Notwithstanding the terms of subsection (a):
(i) Any nonconforming sign existing on October 13, 1985, that is damaged to the
extent that the cost for complete repair does not exceed fifty (50) percent of the
l!": replacement cost of the sign may be repaired.
(2) The message on an nonconforming sign existing on October 13, 1985 may be
changed one or more times after that date provided that no alteration is made to the
sign structure.
(c) All signs and sign structures which are nonconforming to the requirements of
this chapter but which were erected lawfully because of a either by variance
previously granted or because of by conformance with to the previously existing sign
regulations at the time the permit was issued, shall within seven (7) years from
October 13, 1985, the e€feet6e date of tide develepment: eede, be removed by the
owner of the sign or the owner of the property or be brought Into compliance with the
terms contained herein, except for the following:
(1) Any nonconforming sign located on an interstate or federal aid primary
highway (i.e., U.S. Highway 19 and State Road 580 east of U.S. Highway 19) which is
protected from removal by the Federal Highway Beautification Act or Ch. 479, F.S.,
by reason of providing compensation for removal shall be exempted from the removal
terms of this subsection paragraph. This shall not, however, preclude the city from
seeking to remove any such sign through an eminent domain proceeding, nor achieving
sign conformance by"'other lawful means. In the event the Federal Highway
Beautification Act or. Ch. 479, F.S., is repealed, amended or adjudicated to not require

compensation, then the removal provisions contained In this subsection paragraph shall

(2) Any nonconforming sign located on Gulf-to-Bay Boulevard cast of Highland
Avenue which, if said Boulevard was classified a federal aid primary highway, would be
protected from removal by the Federal Highway Beautification Act or Ch. 479, F.S.,
by reason of providing compensation for removal.
(d) The It sitaR be the responsibility of the, development code administrator shall
prepare to undertake an Inventory of fer the purpose of ldentffying and reeerding all
nonconforming signs. Following Identification and recordation, the code administrator
shall notify the property owner or sign owner/lessor identifying the action(s) necessary
to make the sign(s) conform to these sign regulations, the date that such sign(s) shall
be removed if not altered to conform, the opportunity to seek relief through a
variance proceeding and the penalties for noncompliance. Said notice shall be given at
least eighteen (18) months prior to the removal date specified in subsection paragraphs
(e) of this section; under no circumstances, however, shall failure to give or receive
t notice constitute grounds for noncompliance or untimely compliance.
(e) Legal nonconforming signs which exist on property annexed Into the city on
or before October 13, 1992, w'ithiin the severs-year period €ellowlrig adoption of this
development eede shall be subject to the removal or compliance provisions contained
In subsection paragraph (c) of this section. After October 13, 1992, Fellowing seven
(74 years from the date of adeptien of this development eerie sign compliance shall
occur In a time and manner prescribed by the city commission in conjunction with
consideration of the annexation application.
(f) Any person aggrieved by the rerneval or alteration provisions set forth in
paragraph 4e) er {e) of this section may apply to the development code adjustment
board for a variance in accordance with the terms set forth fn ehapter l8? section
137.012. Any request for a variance from terms of safd paragraph Ie} shall be filed
with the development code administrator at least ninety (90) days but riot mere than
eighteen {18) months prior to October 13, 1992 the aferementioned removal date. In
addition to the standards which govern approval of variances contained in said section
137.012, the board shall consider the propriety of the application of this section based
upon the following factors:
(1) Type and extent of the nonconformity (e.g., use, size, height, number, and
setbackT eter).

(2) Location of the nonconforming sign.
(3) Potential adverse aesthetic aeametie effects on the property or building, if
any.
(4) Nature of the surrounding uses, both on-site and off-site.
(5) Locution of the nearest similar sign, if any,
(6) Leasing arrangements, if any.
(7) Date of installation or erection.
(S) Initial capital investment.
(9) Life expectancy of the investment.
(10) Investment realization to date.
(11) Cost to alter or remove sign.
(12) Salvage value.
(13) Part of the owner's or lessor's total business involved.
(114) Monopoly or advantage due to prohibition on similar new signs in the vicinity.
(15) Other factors which may be unique to the property or sign.
The development code adjustment board may grant a variance only after a public
hearing and upon a demonstration by the owner/lessor of a hardship different in kind
and magnitude from that suffered by other sign owners or lessors similarly situated.
Any decision of the development code adjustment board may be appealed to the
heating offfeer in accordance with the leans set €er b 4n ehapter section 137.013.
Section 2. This ordinance shall take effect immediately upon adoption.
