RELATING TO THE LAND DEVELOPMENT CODE; AMENDING
SECTION 138.022, CODE OF ORDINANCES, RELATING TO DESIGN
STANDARDS FOR PARKING LOTS, AND PERMANENT SURFACING aF
REQUIREMENTS FOR UNENCLOSED VEHICULAR ACCESSWAYS'
AND DRIVEWAYS; DELETING THE REQUIREMENT THAT GRASS
PARKING SURFACES SHALL BE IRRIGATED; PROVIDING AN

BE IT, ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Subsections (b), (e), (d) and (e) of Section 136.022, Code of
Ordinances, are amended to read:
Sec. 136.022. Parking standards. a, , t L
(b) Building permit. A building permit shall be required for:
(1) Any proposed new parking lot. I.° `
(2) Any existing parking lot which is proposed to be expanded or reduced.
(3) Any existing parking lot which Is proposed to be restriped In a manner It ' At

(4) Any existing unimproved lot which is proposed to be paved. n'

(1) In general. All parking lots, parking spaces and loading spaces provided

contained in this section, unless determined to be impractical and +

(2} Parking lots serving a new or expanded use. Any parking lot which is to serve a new use of land (including the buildings or structures thereon) shall

space and loading space standards contained in paragraphs W, (e}; {€`) and

(3) Parking lots serving a changed use;- Any, t,drking lot which is to servo a
changed use of land (including the buildings or structures thereon) and
where, through the application of the schedules act forth in subsections

(4) Existing parking lots to be redeveloped. Any part of a parking lot which is
proposed to be redeveloped with a new building or structure and where the
cost of such construction will exceed thirty (30%) of the current assessed
value of the property (as determined by reeerded in the ef-ffee of the county
property appraiser) at the time application is filed for the requisite building
permit, then the parking lot in its entirety shall be required to conform to
all parking lot design standards, surfacing standards, and parking space and
loading space standards contained In paragraphs 4i% {e}; {f} and 4g);
respeetivft of this section, except that where in the joint determination of
the traffic engineer and the develoment code administrator the minimum
number of parking or loading spaces required to serve any remaining
unchanged uses on the property cannot be provided solely because more
stringent design standards are applied to the parking lot which serves such
unchanged uses, then the parking and loading space requirements applicable
to those unchanged uses may be reduced without formal application for a
variance,
(d) Design standards. All parking lots shall be designed to meet the following
standards:
(1) Off-street parking spaces (including aisles) shall be designed in accordance
with the standards identified in the follawing table. Any adjustment of the
standards contained in the table shall require the approval of the traffic
engineer. Furthermore, larger spaces may be required by the traffic
engineer where columns or walls impede maneuverability or vision.

(2) Generally, there shall be not more than one entrance and one exit or one
combined entrance and exit per property along any street unless otherwise
determined necessary by the traffic engineer to alleviate congestion and
Interference of traffic. Access to all parking lots shall be provided in
accordance with the requirements of the traffic engineer.'
(3) With the exception of parking spaces for single-family and two-family
dwellings, no off-street parking space shall be designed In a manner that a
vehicle is required to back into a public right-of-way to gain egress.
(4) Stacking space for drive-through facilities shall be provided and designed in
accordance with the requirements contained in subsection paragraph (g) of
this section.
(5) No circulation aisle shall be closer than three (3) feet to any property line
except where it traverses a property line for the purpose of providing
access,
(6) No portion of any parking space shall be closer than three (3) feet to any
property line except where a parking lot is designed to provide through
circulation to another parking lot on adjoining property, thus functioning as
a single parking lot.
(7) Off-street parking spaces required under the terms of this section shall not
be located within any right-of-way easement nor within the drainage and
utility easement abutting U. S. Highway 19.
(S) Directional signs and surface markings shall be provided as determined
necessary by the traffic engineer.
(9) Lighting shall be provided to illuminate any off--street parking or loading
spaces to be used at night, if provided, the lighting shall be arranged and
installed to deflect, shade and focus lights away from adjacent properties.
The height, type, spacing and degree of cutoff of a light standard may be
further regulated by the building director in relation to specific site
conditions or types of development.
(10) Dire lanes shall be provided as determined necessary by the fire marshal.
(11) Unenelosed parking lots shall be landscaped and buffered In accord with the
provisions contained in section 136.023 of this ehapter.

(a) surfacing:
(1) Permanent surface. Except as othorwiso permitted in are ra h €ellewlttg
ree4W (2), all unenclosed parking lots vehicular aecessways and driveways
,shall be improved with a permanent all-wenthor paving material which is
graded to drain storm water and which shall be subject to the approval of
the city engineer.
(2) Grass surface. Parking lots which serve the following enumerated uses may
be provided with a turf block or other grass parking surface consistent with
the terms contained herein. . Unless otherwise specified herein, this
surfacing technique may be utilized only on parking spaces, not on the aisles
which give access to the spaces. All such spaces shall be remotely located
with respect to the use they serve, shall be irrigated and maintained so as to
present a neat and healthy appearance, and shall be subject to the approval
of the city engineer and traffic engineer.
a. Multiple-family development. Parking lots which serve a multiple-
family development containing more than one hundred (100) dwelling
units may be provided with up to ten (10) per cent of the required
parking space in a turf block or other grass parking surface.
b. Offices. Parking lots which service an office development containing
more than five thousand (5,000) square feet of gross leasable floor
area may be provided with up to thirty (30) per cent of the required
parking spaces in a turf block or other grass parking surface.
C. Retail and service uses. Parking lots which serve retail sales and
service uses (other than those located within shopping centers) whichF
threagh the applieatien e€ the parking sehedule €ermtdae identi€ied in
paragraph 44 of this seetien have a required number of spaces in
excess of twenty-five (25) may be provided with up to twenty (20) per
cent of such required parking spaces in a turf block or other grass
parking surface. However, NetwRhstanding that which precedes;
furniture and appliance showrooms may be provided with up to fifty
(50) per cent of the required parking spaces in a turf block or other
grass parking surface irrespective of the number of spaces required.
d. Shopping centers. Parking lots which serve shopping centers may be
provided with an amount of unpaved parking spaces as follows;

1. Shopping centers having a gross leasable floor area of twenty-
five thousand (25,000) square feet to four hundred thousand
(400,000) square feet may be provided with up to twenty (20)
per cent of the required parking spaces in a turf block or other
gross parking surface,:

hundred thousand (400,000) square feet to six hundred thousand
(600,000) square feet may be provided with; up to fifteen (15) In

e. Churches. Church parking lots which receive infrequent use may be
provided with up to eighty-five (85) per cent of the required parking
spaces in a turf block or other grass parking surface. Access aisles
serving such spaces may, with the approval of the city engineer and
traffic engineer, also be provided .,ith a similar nonpaved surface.
f. Industrial establishments. Parking lots which serve Industrial
establishments and which, through the application of the parking
schedule set forth in subsection (f)€ermulae 4dentiffed 4n paragraph
4 ? of this seetlent, have a required number of spaces In excess of
twenty-five (25) may be provided with up to twenty (20) per cent of
such required parking spaces in a turf block or other grass parking
surface.
g. Public parks. Parking lots which serve public parks may be provided
with up to one hundred (100) per cent of the required parking spaces
in a turf block or other grass parking surface. Access aisles serving
such spaces may, with the approval of the city engineer and the
traffic engineer, also be provided with a similar nonpaved surface.
Section 2. The table set forth in Section 136.022(d)(1), Code of Ordinances, shall
be deleted, and the table set forth In Exhibit A to this ordinance shall be substituted
therefor, in order to incorporate the following changes:

(1) The aisle width (column D) for parking spaces with a parking angle of 50°
shall be decreased from 14.0 feet to 12.0 foot.
(2) The minlmum'overall width for a double row of parking spaces with an aisle
` between (column F) for parking spaces having a parking angle of 80° shall be increased
} from 64.3 foot to 64.6 feet, for parking spaces having it stall width of 9.0 feet, and
from 64.4 feet to 64.8 feet, for parking spaces having a stall width of 9.5 feet.'
Section 3. This ordinance shall take effect immediately upon adoption.
