APPLICAtION FOR PIPE LINE CROSSING/PARALLELISM UNDER/OVER PROPERTIES AND TRACKS
Plans for proposed inatallation shall be submitted to and meet the approval of the Rail-
road Company before construction is begun. Material and installation are to be in strict
accordance with specifications of the American Railway Engineering Association and requirements
of the Seaboard System Railroad. Original and twelve (12) copies of this form shall be
8ubmitted, accompanied by twelve (12) lettersize prints of a drawing showing plan, elevation
section of crossing from field survey, location in respect to Hile Post, width of Railroad's
right of way, location of adjacent structures affecting crossing, and all information required
1n Figures 1 and 2 of AREA Specifications, Part 5 - Pipelines. If open cutting or tunneling
18 necessary, details of sheeting and method of supporting tracks or driving tunnel shall be
shown.

Dear Mr. Champagne:
I am transmitting herewith Application for Pipeline Crossing Under
Properties and Tracks, dated 12/04/86.
The signature and submission of this application is conditioned upon
the following:
1. That the Contractor who is to enter upon your property and perform the
described work is to furnish surety, in a form prescribed by you, sufficient
enough to hold the City of Clearwater harmless from any liability or
responsibility arising out of any application of item #14 of the application
form, either prior, during or subsequent to the work. \
2. That the City of Clearwater will not, as an obligation of the
application approval, accept maintenance or replacement responsibilJty for
the now-existing 42" pipe under the railroad.
3. The City of Clearwater will devote it's normal maintenance capabilities
toward the unstoppage of any blockage that may take place in the n~w
existing 42" pipe under the railroad.
4. The City of Clearwater will accept full maintenance and replacement
responsibility of the new additions to the system described in the
application.
We will enter into a simple agreement which formalizes our position but do
not need a drainage easement at this time.
