AN ORDINANCE OF THE CITY OF CLEARWATmt, FLORIDA;
RELATING , 0 THE LAND DEVELOPMENT CODE; AMENDING
SECTION 236.011, CODE OF ORDINANCES, TO PROHIBIT
TRANSFERS ' OF DEVELOPMENT RIGHTS IN CASES WHERE A
VARIANCE FROM CER'T'AIN REQUIREMENTS IS NECESSARY, AND
TO PROVIDE THAT NO VARIANCE SHALL HE EFFECTIVE IF THE:
VARIANCE IS EDEPENDENT UPON A VRANSFER OF
DEVELOPMENT RIGHTS; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Subsection (f) of Section 136.011, Code of Ordinances. Is amended to
read:
Sec. 136.011. Transfer of development rights.
(f) Developments with transfers and variance. The following shall apply to
developments for which propose to utilize both transferred development rights and one
or more variances from to the otherwise applicable dimensional and numerical
development requirements contained in chapter 136 of this development code are

(1) The city commission shall not approve a request to transfer development
rights where the use of the transferred development rights requires such transfer shall
necessitate a variance from to any other provision contained in this development code
relative to building setback, building height, floor area ratio, waterfront clear space,
off-street parking, building coverage, open space, or any like requfrement except
where such variance has previously been autheriraed by the development code

of development rights alene shall not under any circumstance be allowed to constitute
legitimate grounds for establishing practical difficulty or unnecessary hardship and the
development code adjustment board or the hearing officer shall not consider the
conditions resulting from such proposed transfer as a the basis for a variance.
(2) No such variance authorized by the development cede adjustment beard or
the hearing officer shall be effective where the variance same is dependent upon a
transfer :f development rights unt#} such transfer has been autheriiaed by the city
commission. The city commission shall reserve all rights with respect to any transfer
of development and shall not forfeit or waive its prerogatives under this section
irrespective of any variance that may have been authorized by the development code
adjustment board or the hearing officer that 49 dependent upon a subsequent transfer
of development rights.
