ORDINANCE NO. 4194-86
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE LAND DEVELOPMENT CODE; AMENDING THE
ZONING DISTRICT REGULATIONS FOR THE OPEN
SPACE/RECREATION (OS/R) ZONING DISTRICT TO PROVIDE
THAT THE DISTRICT MAY BE USED FOR PUBLIC: WORKS
PROJECTS AND UTILITY SUBSTATIONS AND FACILITIES ON A
CONDITIONAL USE BASIS, AND TO LIMIT THE AVAILABILITY OF
TRANSFERRING DEVELOPMENT RIGHTS FOR RESIDENTIAL AND
COMMERCIAL USES; AMENDING SECTIONS 135.159, 135.162,
135.163 AND • 135.164, CODE OF ORDINANCES; PROVIDING AN
EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 135.159, Code of Ordinances, Is amended to read:
Sec. 135.159. General description.
This district is created to reserve land areas for parks, open spaces and active
and passive recreation purposes, and other public uses as provided herein.
Section 2. Section 135.162, Code of Ordinances, is amended to read:
Sec. 135.162. Conditional uses.
Within Open Space/Recreation Districts, the following uses may be permitted as
conditional uses:
(1) Restaurant and indoor retail sales; In conjunction with a golf course.
(2) Alcoholic beverage sales (consumption on premises), in conjunction with a
golf course.
(3) Public works_ projects and utility substations and facilities.
Section 3. Section 135.163, Code of Ordinances, is amended to read:
Sec. 135.163. Use limitations.
(a) Alcoholic beverage sales shall comply with all terms contained in chapter
136r, section 136.024.
(b) Accessory uses shall comply with all terms contained in chapter -186
section 136.008.
(c) Public works_projc_ets and utility substations and facilities shall be screened
with a continuous landscape screen or walla roved b the environmental manager*
(d)(e) All uses, whether permitted, conditional or nonconforming, shall be
conducted In compliance eer:senanee with the use standards contained In ehapter 136;
section 136.005.

Section 4. Subsection (5) of Section 135.104, Code of Ordinances, Is added to
read:
See. 135.164, Dimensional and numerical development requirements.
The following dimensional and numerical development requirements shall apply
to development within Open Space/Recreation Districtst
(5) Except as -provided herein, no .residential or commercial uses may be
developed within the Open Space/Recreation District.' However, if the adjoining
upland ro ert is developable and under the same ownershi as the O en
Space/Recreation District ro ert the allowable uses for the O en
Space/ Recreation District ro ert shall be. deemed to be equivalent to the
allowable uses under the zoning district regulations applicable to the ad scent
property for the limited purpose of considering a transfer of development rights
to the adjacent property pursuant-to Section 136.011 provided that the density
or intensity of uses available for transfer shall not exceed the maximum allowed
on the adjoining ro ert .
Section 5. This ordinance shall take effect immediately upon adoption.
