WHEREAS, various provisions in the Land Development Code require that the z9= street right-of-way setback for In-ground swimming pools and screened pool enclosures { is eater than the street right-of-way setback for the greater principal and accessory ??=hP s structure; and WHEREAS, the City Commission finds and declares that a greater street right- , 3 ;W of-way setback for In-ground swimming pools and screened pool enclosures is 9?`Y f4t', unnecessary with respect to single-family, two-family and three-family zoning 4 districts, and that the Land Development Code should be amended as set forth herein; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1.
