ORDINANCE NO. 4161-86
AN ORDINANCE OF THE CITY'-OF CLEARWATER, FLORIDA,
VACATING THE WESTERLY FIVE FEET OF-A TEN FOOT
DRAINAGE AND UTILITY EASEMENT LYING ON THE
EASTERLY BOUNDARY OF LOT 44, COUNTRYSIDE TRACT
60, PINELLAS COUN'T'Y, FLORIDA; PROVIDING AN
EFFEC'T'IVE DATE.
WHEREAS, it has been requested by James F. Askins, Colette T.
hskins and Robert Taucher, owners of certiain real property in
Countryside 'T'ract 60, in the City of Clearwater, Florida, that
the City of Clearwater, Florida, vacate a portion of a certain
drainage and utility easement; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said portion of the drainage and
utility easement is not necessary nor required for municipal use
and it is deemed to be to the best interest and advantage of the
City and the general public that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
The westerly 5 feet of an existing 10 foot
drainage and utility easement lying on the
easterly boundary of Lot 44, Countryside
Tract 60 as recorded in Plat Book 80, pages
78, 79 and 80 of the Public Records of
Pinellas County, Florida, less the southerly
5 feet,
be and the same is hereby vacated, closed and released, and the
City of Clearwater hereby quit claims and releases all of its right,
title and interest thereto to the persons, firms or corporations
entitled thereto by law.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records of Pinellas-County, Florida.
Section 3. This ordinance shall take effect immediately upon
its adoption.
