AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING CERTAIN REAL PROPERTY-LOCATED ON THE
SOUTHWEST CORNER OF McMULLEN BOOTH AND CURLEW
ROADS, PINELLAS COUN'T'Y, FLORIDA, INTO THE CORPORATE
LIMITS OF THE CITY OF CLEARWA'T'ER, FLORIDA, AND
REDEFINING THE DOUNDARY LINES OF T11B CI'T'Y TO
INCLUDE SAID ADDITION; ESTABLISHING THE TIRE
DISTRICT CLASSIFICA'T'ION FOR SAID PROPERTY; PRO-
VIDING AN EFFECTIVE DA'T'E.
WHEREAS, the City Commission of the City of Clearwater, Florida,
received a sworn petition from George W. Clark and Brenda E. Clark,
his wife, and Alfred D. Claris and Ruby G. Clark, his wife, requesting
the City to annex a certain parcel of real estate described here-
inafter, owned by them, into the corporate limits of the City of
Clearwater, Florida; and
WHEREAS, the City Commission, after due consideration of said
petition for annexation, at a regular meeting held on October. 17,
1985, voted unanimously to accept the petition and authorized the
proper officials to set up a public hearing thereon for establishing
the fire district classification and to prepare an ordinance to
annex the property into the corporate limits of the City of
Clearwater; and
WHEREAS, on November 21, 1985, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing
for the establishment of the fire district classification for the
property; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to such required referral`
process; and
WHEREAS, this Ordinance has been referred to and considered
by the PCPC under said process;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. After its evaluation of all evidence presented at
a proper public hearing, the City of Clearwater, acting by and
through its City Commission, by the authority and under the pro-
visions of Section 171.044, Florida Statutes, hereby annexes into
the corporate limits of the City of Clearwater, Florida, and re-
defines the boundary lines of said City so as to.include the
fallowing described real property in Pinellas County, Florida,
and establishes fire district classification therefor:
Commence at the NW corner of the SW 1/4 of section 16,
Township 28 South, Range 16 East, Pinellas County, Florida;
thence S 89°27'53'' E, along the North line of the SW 1/4
of said Section 16, for 170.02 feet; thence S 00°27'00" E,
along a line 169.99 feet East of and parallel to the West
line of•said SW 1/4, for 50.01 feet to the P.O.B., same
being on the South right-of-way line of Curlew Road
(State: Road No.586)); thence S 89°27'53" E, along said
right-of-way line, and along a line 50.00 feet South of
and parallel to the North line of said SW 1/4, for 1119.71
feet to a point on the West right-of-way line of McMullen
Booth Road (County Road No.611); thence S 00°22'44" E,
along said West right--of-way line, and along a line 50.00
feet West of and parallel to the East line of the NW 1/4,
of the SW 1/4 of said Section 16, for 540.70 feet; thence
N 89°30'25" W, along the North line of the plat of Oak
Creek at Countryside, as recorded in Plat Book 82, on page
20 of the Public Records of Pinellas County, for 1289.04
feet to a point on the East right-of-way line of Landmark
Drive; thence N 00°27'00" W, along said right-of-way line,
also being the West line of the SW 1/4 of said Section 16,
for 391.67 feet; thence S 89°27'53" E, along a line 199.99
feet South of and parallel to the North line of said SW 1/4,
for 170.02 feet; thence N 00°2710011 W, along a line 169.99.
feet East of and parallel to the West line of said SW 1/4,
for 150.02 feet to the P.O.B., LESS AND EXCEPT the North 10
feet and the East 50 feet.
The above described property is hereby designated
fire District No. 1.
Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance
with the City's Comprehensive Plan and individual elements thereof
adopted pursuant to the LGCPA and directs that same be forwarded
to the LPA for their receipt and appropriate action.
Section 3. The City Commission hereby accepts the dedication,
of all casements, streets, parks, plazas, places, rights-of-way

CITY OF CLEARWATER, FLORIDA, 1985, AS AMENDED,
BY ZONING CERTAIN REAL PROPER'T'Y LOCATED ON THE

ROADS, UPON ANNEXATION INTO THE CITY OF CLEARWATER,
AS RM-8 AND P/SP ZONING DISTRICTS; PROVIDING
