4124-85ORDINANCE NO. 4124--B5 AN ORDINANCE.OF THE CITY OF CLEARWATER, FLORIDA, RELA'T'ING TO THE EXCHANGE OF SURPLUS REAL PROPERTY, CONSISTING OF A PARCEL Or LAND CONTAINING 3,100 SQUARE FEE'T', MORE OR LESS, AS DESCRIBED MORE SPECIFICALLY HEREIN, LOCATED ON THE NORTHERN BOUNDARY OF MOCCASIN LUKE PARK, ADJACENT TO WEST VIRGINIA AVENUE, FOR ANOTHER PARCEL OF REAL PROPERTY, AS DESCRIBED MORE SPECIFICALLY HEREIN, RAVING A COMPARABLE APPRAISED VALUE,. PROVIDING FOR A SPECIAL ELECTION TO BE HELD CONCURRENTLY WITH THE REGULAR CITY ELECTION ON MARCH 11, 1986, FOR THE PURPOSE OF SUBMITTING TO THE VOTERS OF THE CITY THE QUESTION OF WHETHER THE PROPERTY EXCHANGE SHOULD BE APPROVED; PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 2.01(4)(4), City Charter, provides that surplus municipal real property may be exchanged f r other real property having a comprable appraised value; and WHEREAS, the City owns a parcel of land described herein as Parcel 2, and the City Commission has found and determined that Parcel 2 is surplus and no longer.needed for-public use by the City for the purpose of permitting the exchange of Parcel 2 for Parcel 1, as described herein, which is a parcel of land of equal size'and of comparable appraised value, and which is adjacent to Moccasin Lake Park on its northern boundary; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. Subject to referendum approval, as brovided in Section 2 of this ordinance, and subject further to the approval of the exchange by the Florida Department of Natural Resources, the conveyance of Parcel 2, as described below, in exchange for Parcel 1, as described below, is approved, subject to the condition that the title to be acquired by the City in Parcel 1 shall be no less than the title in Parcel 2 to be conveyed by the City: Parcel 2 From the SW corner of Lot 12, Block 10, Virginia Groves First Addition, as recorded in Plat Book 47, pages 41, 42 and 43 of the Public Records of Pinellas County, Florida,run thence S 1°10'40" W along the Easterly line of West Virginia Lane 60.0 feet for the { P.Q.B.; thence continue S 1°10'40" W, 30.0 feet; thence S 89,040109" E, 105.0 feet; thence N 1°10'40" E, 30.0 feet; thence N 89°40'09" W, 105.0 feet to the P.O.B. ' EXCHANGE OF PARK PROPERTY Ordinance No. 4124-85, as adopted by'the Clearwater t i City Commission on January 16, 1986, approved the exchange of a'parcel of land consisting of 3,150 square feet for a parcel of land of the same size:, bath parcels lying adjacent to the northern boundary of Moccasin Lake Park and having a comparable appraised value. Shall the above described ordinance be approved? Yes No Section 3. This ordinance shall take effect immediately upon adoption, subject to referendum approval as,provided herein, and subject further to the approval of the Florida Department of Natural Resources. s Section 4.
