ORDINANCE NO. 4111-85 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, RELINING TO THE LAND DEVELOPMENT CODE; AMENDING SECTION 136.007 E 2a, CODE OF ORDINANCES, AS CREATED BY THE LAND DEVELOPMENT CODE, TO EXTEND THE DEADLINE FOR THE REGISTRATIO14 OF BUILDINGS OR STRUCTURES WHICH ARE NONCONFORMING AS TO DENSITY OR FLOOR AREA UNTIL DECEMBER 31, 1985; REPEALING EMERGENCY ORDINANCE 4106-85; PROVIDING AN EFFECTIVE DATE. WHEREAS, the recently adopted Land Development Code permits buildings and structures which are nonconforming as to density or floor area to be reconstructed or replaced under certain limited circumstances if such nonconforming density or floor area is registered with the Building Department by the property owner within sixty (60) days following the adoption of the Land Development Code; and WHERAS, because the Land Development Code became effective forty-five (45) days after adoption, allowing only fifteen (15) days between the effective date and the deadline-to register nonconforming densities and floor area; and WHEREAS, the City Commission of Clearwater, Florida, finds it.necessary and desirable to amend Section 136.007 E 2a, Code of Ordinances, in order to extend the expiration date for such registration to-December 31, 1985; r NOW, THEREFORE, HE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: t ' Section 1. Subparagraph a of Paragraph 2 of Sub-section E of Section 136.007, Code of Ordinances, as created by the Land Development Code, is amended to read: Section 136.007--Nonconformities E. Nonconforming Density and Floor Area. Any use of land which exceeds the density or floor area limitations contained in Chapter 135 as determined by zone may be continued subject to the following: 11 Ord. 4111»85 -1- 32/1,9/85 .. 2. Such nonconforming density and floor area once removed or reduced shall not be replaced, except that a use which is identified as permitted or conditional is the zoning district assigned to the property and which is damaged or destroyed by .. natural causes (such as fire, flood, wind and/or tidal surge) in-excess of fifty (50) percent of the replacement cost may be reconstructed or replaced so as to provide the same density or floor .!F1rea that existed prior to such damage or destruction provided: a. Such nonconforming density or floor area was registered with the Building Department prior to the adoption of this Development Code or is registered with the Building Department by the property owner within sixty-{604-Jaye-9e11ewinq the-adeptien-99-this•-Bevelepment-cede on or before December 31, 1985. Section 2. Emergency ordinance 4106-85 is hereby repealed.
