AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE, FIRE PREVENTION CODEI AMENDING
SECTIONS 93.21 THROUGH 93.289 CODE OF ORDINANCES, TO
ADOPT THE NATIONAL FIRE CODES, 1985 EDITION, WITH
CERTAIN AMENDMENTS THERETO EXCLUDING THEREFROM
THE LIFE SAFETY CODE (NFPA 100, AND PROVIDING FOR THE
ENFORCEMENT THEREOF; REPEALING SECTION 93.04, CODE OF
ORDINANCES, RELATING TO THE PROHIBITION OF SMOKING IN
CERTAIN PLACES; REPEALING SECTION 93.20, CODE OF
ORDINANCES, RELATING TO THE ADOPTION OF THE FIRE
PREVENTION CODE, 1976 EDITION; PROVIDING AN EFFECTIVE
DATE. 1,
WHEREAS, the Pinellas County Construction Licensing Board has mandated that
all municipalities In the County of Pinellas adopt the 1985 edition of the Life Safety
Code, which is contained in the National Fire Codes published by the National Fire
Protection Association;
WHEREAS, the City Commission desires to provide the City of Clearwater with
rules and regulations to improve public safety by promoting the control of fire
hazards; regulating the Installation, use, and maintenance of equipment; regulating the
use of structures, premises, and open areas; providing for the abatement of fire
hazards; and establishing responsibilities and procedures for enforcement of these
rules and regulations; and
WHEREAS, the City Commission wishes to exercise the police powers of the
City of Clearwater for the preservation and protection of the public health, peace,
safety and welfare of its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Section 93.04, Code of Ordinances, is hereby repealed.
Section 2. Section 93.20, Code of Ordinances, Is hereby repealed.
Section 3. Section 93.21 is amended to read:
See. 93.21. Adoption of National Fire Codes.
(a) There is hereby adopted by the eity that certain code
known as the National Fire Codes, as published by the National Fire
Protection Association, being partieular}y the 1981 1985 editions
consisting of elxteen 40 eight (8) volumes, excludin therefrom the
Life Safety Code (NFPA 101 , which eerie one eepy thereof 4e now
and has been for the fast preeeding ten {19} days on file •In the offlee
of the eRy elerk, and the same is hereby adapted and Incorporated by
reference as fully as if set out at length herein, and frorn the
effeetWe date -this seetian shaft take effeet; the provisions thereof as
the ma be amended b ordinance from time to time shall be
controlling within the limits o the city- To the extent that the
Pinellas Count Construction Licensing Board as ado to an edition

enforcement o the National Fire Codes. The City Mana er a ter

Section 4. Section 93.22 is amended to read:
See. 93.22. Definitions.
(a) Whenever the word "municipality" Is used in the Ffre
Prevention Bade or the National Fire Codes, It shall be held to mean
the a w4e1paRty of the City of Clearwater, Florida.
(b) Whenever the term "corporation counsel" is used In the
Fore Freventien Eode or the National Fire Codes, It shall be held to
mean the attorney for the City of Clearwater, Florida.
(c) Whenever the term "bureau of fire prevention" Is used in
the Rre Prever t#en bade or the National Fire Codes or this article,
it shall be held to mean the bureau of fire prevention, the fire
prevention division of the fire department of the City of Clearwater,
or any equivalent thereof.
Section 5. Section 93.23 is hereby repealed and a new Section 93.23 is enacted
to read:
Sec. 93.23. Amendments.
The National Fire Codes, as published by the National Fire
Protection Association, 1985 edition, Is amended as follows:
Section 4.2.1 of NFPA 24 concerning the number and location
of fire hydrants is amended to read:
4-2.1 A sufficient number of hydrants shall be installed to provide
two streams for every part of the Interior of each building not
covered by stand pipe protection and to provide hose stream
protection for every exterior part of each building by the use of
the lengths of hose normally attached to the hydrants. There
shall be sufficient hydrants to concentrate the required fire
flow about any important building with no hose line exceeding
300 feet in length.
Section 1-7.2 of NFPA 1 concerning the permitting of bonfires
and outdoor rubbish fires Is amended to Include:
(a) Location restricted. No person shall kindle or maintain
any bonfire or outdoor rubbish fire or authorize any such
rY fire to be kindled or maintained on any privately-owned
land unless the location Is not less than fifty (50) feet or
some other distance approved by the Clearwater Fire
Department from any structure, and adequate provision Is
made to prevent fire from spreading to any structure.

(b) Attendance of open fires. A bonfire or outdoor rubbish
fire shall be constantly attended by a competent person
until the fire Is extinguished. This person shall have a
garden hose conn+tcted to a water supply, or other fire
extinguishing equipment readily available for use.
(c) Chief may prohibit. The chief of the fire department may
in his discretion prohibit any or all bonfires and outdoor
rubbish fires when atmospheric conditions or local
circumstances make such fires hazardous or constitute a
public nuisance.
Section 6.. Section 93.24 is amended to read:
Sec. 93.24. Modification by officials.
The administrator ehief of the bureati of fire preventieM er the
fire prevention d v s on of the fire department, or any equWa4ent
thereefr shall have power to modify any of the provisions of the Fire
Prevention Eede or the National Fire Codes upon application in
writing by the owner or lessee of the property directed affected, or
his duly authorized agent, when there are practical difficulties in the
way of carrying out the strict letter of the code, provided that the
spirit of the code shall be observed, public safety secured, and
substantial justice done. The particulars of such modification when
granted or allowed and the decision thereon shall be entered upon the
records of the department and a signed copy shall be furnished the
applicant.
Section 7. Section 93.25 Is amended to read:
Sec. 93.25. Additional materials, processes or occupancies which may
require permit.
The city manager, the chief of the fire department and the Fire
Marshal shall act as a committee to determine and specify, after
giving affected persons an opportunity to be heard, any now
materials, processes or occupancies, which shall require permits, in
addition to those now enumerated in the Fire Prevention Eedes and
the National Fire Codes. The Fire Marshal shall post such list in a
conspicuous place in his office, and distribute copies thereof to
Interested persons.
Section 8. Section 93.26 is amended to read;
Sec. 93.26. Appeal from denial of permit or decision based on
codes.
Whenever an application for a permit is denied or when it is claimed
that the provisions of the Nre Preventien Eede or the National Fire
Codes do not apply or that the true intent and meaning of the code
have been misconstrued or wrongly Interpreted, the applicant may
appeal, in writing, from the decision of the Fire Marshal ehfef of the
fire prevent#en bureati to the Fire Chief city eensrnissietr within
thirty (30) days from the date of the decision appealed. If the
applicant is not satisfied with the decision of the Fire Ch a upon the
within ten t1u) days from the date the decision of the Fire C:niet is
rendered. The written appeal to the Fire Chief and to the City
Manager shall include the pertinent- provisions o the National Fire
Code a summa of the facts u eon which the a eal s based and a
statement o the relic sought. Ana eal under this section shall b
conducted informally. The decision of the City vlana er shall be
deemed to be final. subiect to udie al review.

Section 10. Section 93.28 is amended to read:
See. 93.28. Penalty applicable to article.
(a) Any person who shall violate any of the provisions of this
article hereby adopted or fail to comply therewith, or who shall
violate or fail to comply with any order made thereunder, or who
shall build in violation of any detailed statement of specifications or
plans submitted and approved thereunder, or any certificate or
permit issued thereunder, and from which no appeal has been taken,
or who shall fail to comply with such an order as affirmed or
modified by the Dire Chief or city manager eemmislen or by a court
of competent jurisdiction, within t eime fixed therein, shall
severally for each and every such violation and noncompliance
respectively, be guilty of a violation m4ademeaner, punishable as
provided in section 1.08. The mpos tion of one penalty for any
violation shall not excuse the violation or permit It to continue; `and
all such persons shall be required to correct or remedy such violations
or defects within a reasonable time.
(b) The application of the above penalty shall not be held to
prevent the forced enforced removal of prohibited conditions.
Section 11. This ordinance shall take effect immediately upon its adoption.
