AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO LAND DEVELOPMEN'T'; REORGANIZING AND
RENUMBERING CERTAIN EXISTING CHAPTERS IN TITLE
XI, CODE OF ORDINANCES, IN ORDER TO ELIMINATE
THE DUPLICATION OF CHAPTER .NUMBERS CREATED BY
THE ADOPTION OF ORDINANCE NO. 4035-85, WHICH
ADOPTED THE LAND DEVELOPMENT CODE; PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the Land Development Code, as adopted by Ordinance No.
4035-85, repealed Chapters 131, 132 and 143, Code of Ordinances,
and adopted new Chapters 131 through 137, inclusive, Code of
Ordinances, to be known as the Land Development Code; and
WHEREAS, the Code of Ordinances as of the date of adoption of
Ordinance No. 4035-B5 contained Chapters 133 through 139, 141 and.
142, which were not repealed by Ordinance No. 4035-85, and therefore
a conflict has been created in the numbering of chapters.in the
Code of Ordinances; and
WHEREAS, the City Commission finds it necessary to reorganize
and renumber said chapters in order to eliminate the conflict created
by the adoption of Ordinance No. 4035-85;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. Title XI of the Code of Ordinances, of the City of
Clearwater, is amended by renumbering Chapters 133 through 139, 141
and 142, ..which. : are reorganized and renumbered as follows:

Section 2. Within each of the chapters renumbered by this
ordinance, each section is hereby renumbered so that the new
chapter number is shown to the left of the decimal point, according
to the style used for the Code of Ordinances generally. The numerals
to the right of the decimal point, and the numbering of subsections,
paragraphs and other subdivisions of cacti section shall remain
unchanged. For example, Section 133.01, Code of Ordinances, is
renumbered as Section 138.01, and each section subsequent thereto
shall be renumbered in a similar manner.
Section 3. The purpose and intent of this ordinance is to
eliminate the confusion resulting from duplicate chapter and section
numbers. This ordinance shall not be construed as an amendment
to the substantive provisions of any ordinance or provision
thereof, nor shall this ordinance be construed as tile readoption
of-any ordinance or provision thereof.
Section 4, Prior to the publication of a supplement to the
Code,of Ordinances containing the chapters and sections renumbered
by this ordinance,. citations or references to a chapter or section
renumbered by this ordinance shall be according to the numbering
system set forth in the Code of Ordinances prior to the publication
of the supplement. After publication of the supplement containing
the chapters and sections renumbered by this ordinance, citations
or references may be in accordance with the numbering system provided
by this ordinance; however, a citation or reference according to the
former numbering system after the publication of the supplement shall
not be deemed to be an improper or incorrect citation or reference
if the context establishes that a citation or reference to a chapter

or section renumbered by this ordinance was intended.

Section 5. With respect to any administrative, judicial or
quasi-judicial proceeding in which the subject matter is based upon
or pertains to any chapter or section of the Code of Ordinances
which has been renumbered by this ordinance, the proceeding shall
continue as if this ordinance had not been adopted, and nothing
herein shall be construed to require the refiling or the recommencement
of any such proceeding. During any such proceeding, the fact that
' a chapter or section of the Code•of Ordinances has been renumbered
r, by this ordinance may be noted for the record, and subsequent pleadings,

papers, orders, resolutions, ordinances, meeting minutes, and other
documents pertaining to the proceeding may cite or refer'to the
chapter or section according to its new number'
Section 6. This ordinance shall take effect immediately upon
adoption.
