ORDINANCE NO. 4090-85
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ABOLISHING THE PLANNING AND ZONING BOARD, THE BOARD
OF ADJUSTMENT AND APPEAL ON ZONING, AND THE
HISTORICAL COMMITTEE; APPOINTING THE INCUMBENT
MEMBERS OF SAID BOARDS TO THE PLANNING AND ZONING
BOARD, THE DEVELOPMENT CODE ADJUSTMENT HOARD, AND
THE.HISTORIC PRESERVATION BOARD, RESPECTIVELY, FOR
THE DURATION OF THEIR CURRENT TERMS OF OFFICE;
ABOLISHIN G THE BOARD OF ADJUSTMENT AND APPEAL ON
SIGNS; PROVIDING FOR THE TRANSITION OF DUTIES AND
FUNCTIONS OF SAID BOARDS; REPEALING EMERGENCY t`
ORDINANCE 4469.85 ON THE SAME SUBJECT; PROVIDING AN
EFFECTIVE DATE.
BE rf ORDAINED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA: ,.
Section 1. Notwithstanding any other ordinance or provision thereof to
the contrary, the following transition rules shall govern the establishment of the
following boards:
(1) The Planning and Zoning Board, established pursuant to Section
131.009, Code of Ordinances, is hereby abolished, and the members thereof are hereby
appointed to the Planning and Zoning Board established by Section 137.019, Code of
Ordinances, as created by the Land Development Code.
(2) The Board of Adjustment and Appeal on Zoning, established pursuant
to Section 131.016, Code of Ordinances, is hereby abolished, and the members thereof
are hereby appointed to the Development Code Adjustment Board established by
Section 137.020, Code of Ordinances, as created by the Land Development Code.
(3) The Historical Committee, established pursuant to Sections 22.30 -
22.33, Code of Ordinances, Is hereby abolished, and the members thereof are hereby
appointed to the Historic Preservation Board established by Section 137.023, Code of
Ordinances, as created by the Land Development Code.
(4) The term of each appointment shall expire on the expiration date of
the term to which the member was last appointed to a board abolished by this
ordinance.

(5) To the extent that the number of members appointed by this ordinance
to a board established by the Land Development Code exceeds the number of members
authorized for that board by the Code of Ordinances, the Code of Ordinances shall be
deemed amended to authorize the number of members appointed by this ordinance.
However, no person shall be appointed or reappointed to any of the newly established
boards after the effective date of this section until such time as the membership on
the board is less than the number of members authorized for the board.

(6) At the time the membership of a board established by the Land
Development Code becomes less than the number of members authorized for the
board, the City Commission may appoint or reappoint members to terms shorter than
the three-year terms provided in the Code of Ordinances as may be determined
necessary to provide staggered expiration dates.
(7) The Board of Adjustment and Appeal on Signs is hereby abolished.
(8) As of the effective date of this section, the duties and functions of
each board abolished by this ordinance shall be transferred to and assumed by the
board to which the incumbent members are appointed as provided herein, except that
pending requests for special exception uses shall be transferred from the Board of
Adjustment and Appeal on Zoning to the Planning and Zoning Board and pending
requests for sign variances shall be transferred from the Board of Adjustment and
Appeal on Signs to the Development Code Adjustment Board.
Section 2. Emergency Ordinance +1069-85 is hereby repealed.
Section 3. This ordinance shall take effect immediately upon adoption.
