MUTUAL AID AGREEMENT FOR FIRE PROTECTION
TH}}AGREEMENT entered into this ~Yvt/ day
,,-I , 1969, between the CITY OF CLEARWATER,
municipal corporation, hereinafter referred to
as "Clearwater," and the City of Safety Harbor , a
Florida m~nicipal corporation} hereinafter referred to
as "Safety Harbor I II for the purpose of securing to each
municipality and its citizens the benefits of mutual
aid in the protection of life and property from fire and
in fire fighting within the corporate limits of said
respective municipalities.
NOW, THEREFORE, in consideration of One Dollar
and other good and valuable consideration, receipt of which
is hereby acknowledged} and the foregoing premises and
the covenants to be performed herein by the respective
parties, the parties hereto covenant and agree as follows:
1. The terms and provisions of this Agreement
shall be binding upon the parties from the date of the full
execution of this Agreement and shall continue in force
and effect until terminated by either party after furnishing
sixty (60) days written notice of termination to the other
party, or as terminated as herein provided.
2. Clearwater and Safety Harbor mutually covenant
and agree to provide free of charge to one another for the
purpose of fighting fires in said respective municipalities,
the fire fighting equipment and personnel which said
requesting municipality can reciprocally provide in return
to the responding municipality.
3. Upon request to a representative of the City
of Clearwater Fire Department by the Fire Chief or his
duly authorized representative of the City of Safety Harbor
Fire Department, fire fighting equipment and personnel

of the City of Clearwater Fire Department will be dispatched
to any point within the municipal limits of the City of
Safety Harbor as designated by the Fire Chief or his duly
designated representative of the City of Safety Harbor Fire
Department.
4. Upon request to a representative of the City
of Safety Harbor Fire Department by the Fire Chief or his
duly authorized representative of the City of Clearwater
Fire Department, fire fighting equipment and personnel of
the City of Safety Harbor Fire Department will be dispatched
to any point within the municipal limits of the City of
Clearwater as designated by the Fire Chief or his duly
authorized representative of the City of Clearwater Fire
Department.
5. Any dispatch of said equipment and personnel
pursuant to this Agreement is subject to the following
conditions and terms:
a. Any request for aid hereunder shall
include a statement of the amount and type of equipment
and number of personnel r~quested, and shall specify the
location to which the equipment and personnel are to be
dispatched, but the amount and type of equipment and the
number of personnel to be furnished shall be determined
by the Fire Chief or his duly authorized representative of
the responding municipality.
b. The equipment and personnel of the
responding fire department shall report to the officer in
charge of the requesting fire department at the location
to which the equipment is dispatched and all such equipment
shall be manned, operated and supervised by the personnel
of the responding fire department.
c. The responding fire department's equipment
and personnel shall be released by the requesting fire

department when the services of the responding fire depart-
ment are no longer required or when the equipment and personnel
of the responding fire department are needed within the area
for which it normally furnishes fire protection.
6. If the fire department of the requesting
municipality is not equipped and able to provide to the
responding municipality on a reciprocal basis the fire fighting
equipment and personnel which it is requesting of the responding
municipality, the responding municipality shall not be
obliged to furnish such equipment and personnel.
7. All equipment used by the City of Clearwater
Fire Department in carrying out this agreement will at the time
of the action hereunder be owned by it and all personnel
acting for the City of Clearwater Fire Department under this
agreement will at the time of such action be employees of the
Clearwater Fire Department. All equipment used by the City
of Safety Harbor Fire Department in carrying out this agreement
will at the time of the action hereunder be owned by it and all
personnel acting for the City of Safety Harbor Fire Department
under this agreement will at the time of such action be
employees of the Safety Harbor Fire Department.
8. The responding fire department or municipality shall
not be required to answer requests for assistance in furnishing
equipment and personnel outside the municipal limits of said
City or Town, if, within the discretion of the Fire Chief of
said respective Fire Department or his duly authorized represen-
tative, it is determined that answering of said request for
assistance will unreasonably interfere with or jeopardize the
fire protection and safety of the citizens and property within
the corporate limits of the responding municipality.
9. This contract shall in no event confer upon any
person, property owner or any municipality the right of damages
against the responding municipality for operation or failure

to operate hereunder in accordance with the terms of this
agreement.
10. The terms and provisions of this agreement
shall inure to and be binding upon the parties hereto,
their successors and assigns.
