A•,.. ...., v!h yr?c:?L?.??.•.•. ,t:f hx ^, r ORDINANCE NO. 4055-85 0 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING SECTION 110.04, TRADING ON STREETS-- WHEN PROHIBITED, OF CHAPTER 110, IN GENERAL, OF TITLE IX, STREE'T'S, SIDEWALKS AND OTHER PUBLIC PLACES, OF CODE OF ORDINANCES, CITY OF CLEARWATER, TO PROVIDE THAT SAME MAY BE LAWFUL WHEN AUTHORIZED UNDER ARTICLE III, SPECIAL EVENTS, OF CHAPTER 116, OF THE CODE OF ORDINANCES; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT ,HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE PROPER NO'T'ICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1.- That Section 110.04, Trading on streets--when prohibited, of Chapter 110, In General, of Title-IX, Streets, Sidewalks and Other Public Places, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 110.04. Trading on streets--When prohibited. Unless authorized under Article III, Special Events, of Chapter 116, of the code of ordinances, it shall be unlawful for any person to sell, barter, exchange, or offer to sell, barter or exchange any goods, wares or merchandise of any kind or nature whatsoever in, or on or over'any street, right-of-way or public property, sidewalk or park within the city; except that this section shall not apply to curb service furnished by any regularly established and licensed place of business in the city, and provided that this section shall not apply to the. holding of bazaars'or other sales not made or carried on for personal profit, where the same are operated in front of or adjacent to a store or place of business with the consent'of the owner or manager thereof; and further provided that the prohibition set out herein shall not prevent the operation of,an outdoor cafe on the public sidewalk where the following requirements have been met: (1) At least five (5) feet of unobstructed sidewalk available for pedestrian use must be available following installation of the sidewalk cafe. (2) A revocable permit to install the sidewalk cafe must be obtained from the City by the licensed restaurant owner and recorded in the Public Records of Pinellas Ccunty. Such use may only be considered for installation adjacent to a restaurant use. (3) All elements or components utilized to construct the sidewalk cafe must be movable and no element or component may be bolted or otherwise affixed to the public sidewalk. Prior to the installation of any element or component, a building permit shall be obtained. (5) The applicant provides the City with a copy of a policy of insurance, which policy shall name the City as a named insured, covering both property damages and personal injuries that might ? • occur by reason of such use of the public ' sidewalk, Such policy shall have limits of at least $50,000 for property damages and $500,000 for personal injury liability, and must be approved by the City prior to the issuance of a revocable s permit. F Section 2. All ordinances or parts of ordinances in conflict' herewith are to the extent of such conflict hereby repealed. y Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, a or any part thereof other than the part declared to be invalid. - } Section 4_ Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5.
