WHEREAS, the Community Relations Code contains two conflicting definitions of age; and WHEREAS, it is necessary to bring the code up-to-date and in conformance with the Pinellas County Code; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. No employer shall refuse employment to the physically handicapped on the ;oasis of disability alone unless it is shown that the particular disability prevents the satisfactory performance of the work involved. For the purposes of this chapter, "physical handicap" shall refer to any stabilized physical disability, informity, malformation or disfigurement which is caused by bodily injury, birth defect, or illness. Should any part or provision` of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. Section 3. All. ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. Section 4, Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5. The provisions of this ordinance shall take effect immediately upon its passage.
