AN ORDINANCE REPEALING THE ZONING ATLAS OF THE
CI'T'Y OF CLEARWA'T'ER, FLORIDA, 1985, AS AMENDED,
AND REPEALING CHAPTER 131, ZONING, CHAP'T'ER 132,
SUBDIVISION AND CHAP'T'ER 143, SIGNS, OF 'T'I'T'LE XI,
OF THE CODE OF ORDINANCES; AND ADOPTING A NEW
ZONING ATLAS OF THE CITY OF CLEARWA'T`ER, FLORIDA,
1985, AND ADOP'T'ING NEW CHAPTER 131, PREAMBLE,
CHAPTER 132, ANNEXATION, CHAPTER 133, SUBDIVISION
AND CONDOMINIUM PLATTING, CHAPTER 134, SIGN
REGULATIONS, CHAPTER 135, ZONI14G DISTRICT REGULATIONS,
CHAPTER 136, UNIFORM DEVELOPMENT REGULA'T'IONS, 'AND
CHAPTER 137, ADMINISTRATION AND ENFORCEMENT, TITLE XI
OF THE CODE OF ORDINANCES; TO BE KNOWN AS THE LAND
DEVELOPMENT CODE, WHICH PERTAINS TO THE ESTABLISHMENT
OF REVIEW PROCEDURES FOR MUNICIPAL ANNEXATION, SUB-
DIVISION AND CONDOMINIUM PLATS; S'T'ANDARDS FOR SIGN
PLACEMENT, INCLUDING REQUIREMENTS FOR SIGN COMPLIANCE
AND AMORTIZATION; THE ESTABLISHMENT OF ZONING
DISTRICTS APPLICABLE TO ALL LAND WITHIN THE CORPORATE
LIMITS OF CITY; PERMITTED AND CONDITIONAL USES WITHIN
EACH ZONING DISTRICT.'; USE LIMITATIONS FOR PERMITTED
AND CONDITIONAL USES; THE DENSITY, FLOOR AREA RATIO,
LOT AREA, LOT WIDTH, LOT DEPTH, HEIGHT, BUILDING
COVERAGE, BUILDING SEPARATION AND OPEN SPACE RE-
QUIREMENTS; REGULATIONS CONCERNING NON-'CONFORMITIES,
TRANSFER OF DEVELOPMENT RIGHTS, FENCES, PARKING,

PERMITTING AND REVIEW PROCEDURES INCLUDING SITE
PLANS, VARIANCES, CONDITIONAL USES, DEVELOPMENT
CODE AMENDMENTS, ZONING ATLAS AMENDMENTS AND LAND
USE PLAN AMENDMENTS; RESPONSIBILITIES OF BOARDS
AND CITY STAFF; NOTICE AND HEARING REQUIREMENTS;
THE PROVISION FOR THE ADMINISTRATION, INTERPRE'T'ATION
AND ENFORCEMENT OF THE LAND DEVELOPMENT CODE; AND
THE PROVISION FOR THE REPEAL OF ORDINANCES OR PART
OF ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR
THE SEVERABILITY OF THE PROVISIONS HEREOF, PROVIDING
FOR THE PROPER NOTICE OF PROPOSED ENACTMENT, AND TO
PROVIDE PENALTIES FOR THE VIOLATION OF THIS ORDINANCE
AND PROVIDE FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, on August 13, 1985, the City Commission of the City of
Clearwater, after proper public notice, held a public hearing on
certain proposed changes to the Zoning Atlas of the City of
Clearwater and to the Zoning Ordinance of the City of Clearwater
in accordance with procedure as established; and
WHEREAS, the City Commission has fully considered the
recommendations and report of the Planning and Zoning Board relative
to the certain proposed changes to the Zoning Atlas and to the
Zoning Ordinance; and
WHEREAS, certain of the proposed changes and amendments to the
Zoning Atlas and to the Zoning Ordinance were approved by the City
Commission after its evaluation of all evidence presented at the
said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments

thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Ageiicy for Pinellas County and the
PCPC has adopted guidelines with reference to such required
referral process; and /
WHEREAS, this Ordinance has been referred to and considered
.by the PCPC under said process; ,
NOW, THEREFORE, BE IT ORDAINED BY THE C'I'TY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the Zoning Atlas of the City of Clearwater,
Florida, 1985, as amended, and Chapter 131, Zoning, Chapter 132,
Subdivision, and Chapter 143, Signs, of Title XI, of the Code of
Ordinances, City of Clearwater, are hereby repealed in their
entirety.
Section 2. That a new zoning Atlas of the City of Clearwater,
Florida, 1985, and anew Chapter 131, Preamble, Chapter 132,
Annexation, Chapter 133, Subdivision and Condominium Platting,
Chapter 134, Sign Regulations, Chapter 135,, zoning District
Regulations, Chapter 136, Uniform,Development Regulations, and
Chapter 137, Administration and Enforcement, of Title XI, of the
Code of Ordinances, City of Clearwater, are hereby adopted to
read as follows:

Section 3. The city of Clearwater does hereby certify that
the measures contained in this ordinance are consistent and in
conformance with the City's Comprehensive Plan and individual
elements thereof adopted pursuant to the LGCPA and directs that
same be forwarded to the LPA.for their receipt and appropriate
action.
Section 4. Should any part or provision of this ordinance be
declared by a court of.competent jurisdiction to be invalid, the
same sha11 not affect the validity of the ordinance as a whole,.or
any part thereof other than the part declared to be invalid.
Section 5. All ordinances or parts of ordinances in conflict
herewith to the extent of such conflict are hereby repealed.
Section 6. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
i Section 7. The provisions of this ordinance shall take effect
forty-five'(45) days after passage.
