Oft ORDINANCE NO. 4034-85 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ARTICLE V, MUNICIPAL CODE' ENFORCEMENT BOARD, OF CHAPTER 22, APPOINTIVE BOARDS AND COMMITTEES, OF TITLE 11, ADMINISTRATION OF THE CODE OF ORDINANCES, CITY OF CLEARWA'ITIt, TO PROVIDE THAT THE BOARD SHALL CONDUCT HEARINGS RELATING TO ENFORCEMEN'T' OF CODES AND ORDINANCES WHICH HAVE NO CRIMINAL PENALTY WHERE A PENDING OR REPEATED VIOLATION CONTINUES TO EXIST; CLARIFYING ENFORCEMENT PROCEDURES AND POWERS OF THE BOARD; PROVIDING FINE FOR REPETITION OF SAME VIOLATION BY SAME VIOLATOR; PROVIDING THAT THE BOARD MAY AUTORME FORECLOSURE ON LIENS AFTER SIX MONTHS; PROVIDING THAT NO LIEN MAY BE FORECLOSED ON HOMESTEAD PROPERTY; LIMITING APPEAL TO APPELLATE REVIEW OF RECORD CREATED BEFORE BOARD; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the legislature of the State of Florida, during the 1985 Section 1. That Section 22.61, Function, appointment and term of office, of Article V, Municipal Code Enforcement Board, of Chapter 22, Appointive Boards and Committees, of Title 1I, Administration, of the Code of Ordinances,. City of Clearwater, be and the same is hereby amended to read as follows: Sec. 22.61. Function, appointment and term of office. (a) The Clearwater Code Enforcement Board shall have the purpose of conducting hearings relating to the enforcement of leehn'iee} codes and ordinances which have no criminal penalty, In force in Clearwater, where a pending or repeated violation continues to exist Including but not limited to occupational license, fire, building, zoning and sign codes. Section 2. That Section 22.64, Enforcement procedure, of Article V, Municipal Code Enforcement Board, of Chapter 22, Appointive Boards and Committees, of Title 11, Administration, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as•follows: Sec. 22.64. Enforcement procedure. Legislative Session, passed legislation CS/HB 328 which made several changes to the general statutes governing Code Enforcement Boards; and WHEREAS, it is necessary to revise current sections of the Code of Ordinances to take into consideration such revisions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA; Except where the Inspector charged with enforcing a particular 4eehrAee{t code or identified herein has reason to believe that a code violation presents a serious threat to the public health, safety and welfare, the code enforcement procedure under this article shall be as follows: (1) It shall be the duty of the code inspector to Initiate enforcement proceedings with respect to each 4eehrtfeel• code or ordinance. That Section 22.68, Appeal, of Article V, Municipal Code Enforcement Board, of Chapter 22, Appointive Boards and Committees, of Title II4 Administration; of the Code of Ordinances, City of Clearwater, be and the same Is hereby amended to read as follows: .f _ Sec. 22.68. Appeal. Any aggrieved party, Including the local governing body, may appeal , R a final administrative order of the Clearwater Code Enforcement Board in the circuit court of any county. Such an appeal shall not be a herein de ' novo, but shall be limited to appellate review o the record created before _ the enforcement board. The appeal provided for herein shall be filed wit?n t rrty 30 days of the execution of the order to be appealed. , 2 _ . .:1 4 ` IF Section 6. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be Invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof, other than the part declared to be invalid.
