' ll: i" ?t:.'.,:"• ' €s• ,"a' - Diu ???: i SEEN "37;. t?"M a.. 4 w .. r' ORDINANCE NO. 4019-05 ?r AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, COMPLYING WITH THE "LOCAL GOVERNMEN'T' COMPRE- HENSIVE PLANNING ACT OF 1975", AS AMENDED; ADOP'T'ING THE UPDATED HIS'T'ORIC PRESERVATION ELEMENT AS PAR'T' OF THE COMPREHENSIVE PLAN FOR THE ENTIRE CITY OF CLEARWATER, FLORIDA; ADOP'T'ING THE ATTACHED EXHIBI'T'; PROVIDING FOR PROPER NOTICE OF PROPOSED ENAC'TMEN'T'; AND PROVIDING FOR THE 'EFFECTIVE DATE; OF' THIS ORDINANCE. WHEREAS, the City of Clearwater previously adopted ordinance No. 1891, on March 1, 1979, adopting the, Historic Preservation Element as part of the Comprehensive Plan for the entire City of Clearwater; and ; WHEREAS, an Evaluation and Appraisal Report measuring the effectiveness of this'element has been prepared and the Historic Preservation Element has-been updated; and WHEREAS, this updated Element has been reviewed.by the various agencies required to do so and each has recommended adoption thereof; NOW, 'T'HEREFORE BE IT ORDAINED BY THE CI'T'Y COMMISSION OF THE CI'T'Y OF CLEARWATER, FLORIDA: Section 1. The updated historic preservation element of the comprehensive plan as required by the "Local Government Comprehensive Planning Act of 1975", as amended, and as set forth in the attached exhibit, described as: Composite Exhibit A - Document entitled "Historic Preservation Element - Revised", consisting of a table of contents sheet and 50 pages, is adopted in accordance with the "Local Government Comprehensive Planning Act of 1975", as amended, for the entire City of Clearwater, Florida. Section 2. The attached exhibit described as: Composite Exhibit A -- Document entitled "Historic Preservation Element - Revised", consisting of a table of contents sheet and 50 pages, is adopted as part of this ordinance as if it was set forth in full herein. Section 3. Section 4. All required and optional elements and parts of the 'Comprehensive Plan as required or allowed by the "Local Government Comprehensive Planning Act of,197511, as amended, which are set forth in the attacned exhibit adopted herein, are hereby adopted as part of this ordinance. Section 5. All development undertaken and all actions taken in regard to development orders, all land development regulations enacted or amended shall be consistent with this Plan and such updated element and part thereof in regard to the land covered by this updated element and portions of the Comprehensive Plan as hereby adopted shall be consistent with this Plan and each element and part thereof. Section 6. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in,accordance with Section 166.041, Florida Statutes. Section 7. All public hearings and public participation .r required pursuant to Section 163.3181, Florida Statutes, and Section 163.3184, Florida Statutes, has preceded the consideration of this ordinance.. -2- !
