ORDINANCH NO. 4015-05
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A CERTAIN ALLEY 1N COURT SQUARE SUIT--
DIVISION, PINELLAS COUNTY, FLORIDA; PROVIDING
FOR PROPER NOTICE OF PROPOSED ENACTMENT; AND
PROVIDING FOR THE EFFECTIVE DATE, OF T11IS ORDINANCE.
WHEREAS, it has been requested by John P. Hannigan, owner of
crrtain reel property in Court Square Subdivision, in the City o
Clearwater, Florida, that the City of Clearwater, Florida, vacate
a'certain ally; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said alley is not necessary nor
required for municipal use and it is deemed to be to the best
interest and advantage of the City and the general public that the
same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
That certain alley lying between Lots 19, 20, 23
and 24 of Court Square Subdivision, according to the
map or plat thereof as recorded in Plat Book 5, page
53 of the Public Records of Pinellas County, Florida,
be and the same is hereby vacated, closed and released, and the City
of Clearwater hereby quit claims and releases all of its right, title
and interest thereto to the persons, firms or corporations entitled
thereto by law, excepting that the property owner shall pay to
relocate existing utilities in the alley if same is required by
the City of Clearwater.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records of Pinellas County, Florida.
Section 3. Notice: of the proposed enactment of this ordinance
'has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section,4. This ordinance shall become effective immediately
upon its passage.
