WHEREAS, on June 6, 1985, the City Commission of the City of „.

Clearwater, after proper public notice, held a public hearing for a?f? ,

the determination and establishment of zoning classifications for
certain property annexed into the City of Clearwater in accordance r

with procedure as established; and
WHEREAS, certain of the amendments to the zoning atlas for
h establishing zoning for such newly annexed real property were i
approved by the City Commission after its evaluation of all
evidence presented at the said public hearing; and

WHEREAS, the Local Government Comprehensive Planning Act w

(LGCPA) requires that all development regulations and amendments •`
A thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to LGCPA; and
WHEREAS, the.Pinellas County Planning Council (PCPC) has'been
designated the Local Planning Agency for Pinellas County and the 5 'N
PCPC has adopted guidelines with reference to such required
referral process; and
WHEREAS, this ordinance has been referred to and considered ,Ks
by the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:

A parcel of land located in the SW 1/4 of Section
19, 'T'ownship 29 South, Range 16 East, Pinellas
County, Florida, also being a portion of Lot 19
of the Plat of Pinellas Groves, as recorded in
Plat Book 1, page 55 of the Public Records of
Pinellas County, Florida, being more particularly
described as follows:
Commence at the SE corner of the Plat of 1lulett
Estates, as recorded in Plat Book 56, page 64,
Public Records of'said Pinellas County, being the
P.O.B.; thence N 00°31125" E, along the West boundary
of said Lot 19, for 449.14 feet; thence S 89°0512311 E
for 105.00 feet; thence N 00°2914511 E for 185.01 feet
to a point on the South right-of-way line of Nursery
(a 33 foot half right-of-way); thence S 89°091 04F1 E,
along said South line, for 98.32 feet; thence S 00°
36140" W for 135.06 feet; thence S 89°0911611 E for
99.95 feet to a point on the East boundary of said
Lot 19, and along said boundary for the following 2

Section 2. The City of Clearwater does hereby certify that the
measures contained in this ordinance are consistent and in conformance
with the City's Comprehensive Plan and individual elements thereof
adopted pursuant to the LGCPA and directs that same be forwarded
to the LPA for their receipt and appropriate action.
Section 3. All ordinances or parts of ordinances in conflict,.
herewith are to the extent of such conflict hereby rpeealed.
Section 4. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and
set out and show upon the official zoning atlas of the City of
Clearwater the foregoing amendment as hereinabove set out.
Section 7. The provisions of this ordinance shall, take effect
immediately upon its passage,.
