ORDINANCE NO. 4010-85
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING CHAPTER 20, RECORD PLATS AND SUBDIVISIONS,
OF THE 19G2 CODE OF ORDINANCES, WHICH CHAPTER WAS
SAVED FROM REPEAL BY CHAPTER 132, SUBDIVISIONS;' OF
TITLE XI, BUILDING AND ZONING REGULATIONS, OF THE
CODE OF ORDINANCES, CITY OF CLEARWATER, TO PROVIDE
REQUIREMENTS FOR STORMWATER DETENTION BASINS AND
THEIR MAINTENANCE; PROVIDING FOR REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR THE SEPARABILITY OF THE
PROVISIONS HEREOF; PROVIDING FOR PROPER NOTICE OF
PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, it is necessary to amend and clarify the current
valid Chapter 20, Record Plats and Subdivisions, of the 1962 Code
of ordinances, which chapter was saved from repeal by Chapter 132,
Subdivisions, of Title XI, Building and Zoning Regulations, of
the Code of Ordinances, City of Clearwater, to set forth standards
'such as will ensure.that stormwater detention basins provided by
private subdividers will remain private property and shall have
minimum opportunity to become a burden to the taxpayers of Clearwater
by certain circumstances of neglect or default;
NOW, THERFORE, BE IT ORDAINED-,BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Paragraph (2), Easements for utililties, of
Sub-section (D), Public use and service areas, of Section 20-11,
General Requirements and Minimum Standards of Design, of Article
II, Subdivision Standards, of Chapter 20, Record Plats and Subdivisions,
of the 1962 Code of Ordinances, which Chapter was saved from repeal
by Chapter 132, Subdivisions, of Title XI, Building and Zoning Regu-
lations, of the Code of Ordinances, City of Clearwater, is hereby
amended to add the following:
Stormwater detention basins must be included within
the lot lines of one or more adjacent ro erties and
may .not be se arate parcels unto themselves. Subdividers
who wish to provide for the continuing maintenance of
detention basins by a form of common responsibility assigned
to a certain group or association may do so by restrictive
covenants or other instruments but shall not by plat designate
owner shi of the basin area to such group or association.
Section 2. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.

Section 3. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
` Section 4. Notice of the proposed.enactment of this ordinance
` has been properly advertised in a newspaper of general circulation.

Section 5. The provisions of this ordinance shall take effect
immediately upon its passage.
