AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING TITLE V, U'I'II.PT Es, OF THE CODE OF ORDINANCES,
CITY OF CLEAR WATE119 TO INCREASE THE WATER RATE;
PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR AN ANNUAL RATE ADJUSTMENT TO
COMPENSATE FOR TII1; CONSUMER PRICE INDEX TREND;
PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR NOTICE
OF PROPOSED ENACTMENT; AND PROVIDING FOR AN
EFFECTIVE DATL FOR THIS ORDINANCE.
WHEREAS, the current water rate has been effective since August 20,
1981; and
WHEREAS, the price charged for water has increased 28.4% since July,
1974, while inflation, as measured by the Consumer Price Index, has increased 95.8%
In the same time period; and
,
WHEREAS, the City's water system lost $217,600 in the 1983/84 fiscal
year; and
WHEREAS, the current 1984 Water and Sewer Revenue Bond Ordinance
requires the City will always provide gross revenues In each fiscal year sufficient to
pay the cost of operation and maintenance of the system in such fiscal year 115 per
centum (115%) of the bond service requirement becoming due In such fiscal year on
the outstanding 1984 bonds and on all outstanding additional bonds plus 100 per centum
(100%) of all reserve and other payments required to be made pursuant to the
ordinance. Such rates, fees, rentals and other charges shall not be reduced so as to be
insufficient to provide gross revenues for such purposes; and
WHEREAS, the wholesale rate for water has increased 65% since the
current rate was established; and
WHEREAS, no compensation or adjustment is made to offset the effects of
inflation or deflation;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Subparagraph (1) of Subsection e, Rates, of Section 50.05,
Deposit, Fees, Service Charges and Rate Schedule, of Chapter 50, in General, of
Title V, Utilities, of the Code of Ordinances of the City of Clearwater, is hereby
repealed in its entirety and the following Subparagraph (1) is hereby enacted:
(1) Water rates for all water furnished by the City Utilities Department under
the different schedules shall be as follows:

b. Lawn water meters. Lawn water meters shall be charged the regular
domestic rate for water used for irrigation purposes In accordance
with the ordinances of the City. When combined with the domestic
V meter on the same WE, the rate shall be at the current approved

When on a separate bill, the rate will be charged the regular domestic
rate (less sewer) depending on the size of the meter.
C. Service out of municipal limits: Accounts outside of the corporate
•:; r:., limits of the city shall be subject to a surcharge equal to thirty-five
f' (35) per cent of the monthly water bill charges as set forth in
subsections a. and b. above.
d, A char of the "monthly minimum" for a one-and-'one-half (1-1/2)
inch water meter is required for a "deduct" meter for air conditioning
cooling water and similar purposes. (This is to omit the sanitary
sewer charge for this consumption.) This is only where a separate
r„ irrigation meter, cannot be set in the right-of-way or easement and
rrv - the meter reader must physically read and deduct consumption for
` 'r f billing purposes.
e. The rates in subsections a. and b. above shall be adjusted periodically
to recover increased cost to supply water due to changes in the
wholesale rate the city pays for water. Such rate adjustment shall be
r set by the utilities director with concurrence by the city manager.
Further, such adjustment shall be a percentage increase based upon
? the percentage of water the city buys wholesale to total system

Section 2. Should any section, paragraph, sentence or word of this
ordinance be declared for any reason to be invalid, the same shall not affect the
ry validity of the ordinance as a whole, or any part thereof other than the part declared

to be invalid.
Section 3. All ordinances or parts of ordinances in conflict herewith are
to the extent of such conflict hereby repealed.

Section 4. Notice of the proposed enactment of this ordinance has been
properly advertised in a newspaper of general circulation in accordance with Section
`. " 166.041, Florida Statutes.
'c Section 5. This ordinance shall become effective immediately upon its
passage.
