AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1985, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPER'T'Y
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLICT; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on April 18, 1985, the City Commission of the City of"
Clearwater, after proper public notice, held a public hearing on
certain proposed changes to the zoning atlas of the City of Clear-
water in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its evalua-

tion of all evidence presented at the said public hearing; and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local Planning Agency (LPA) for confprmance with
plans adopted pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council (PCPC) has been
designated the Local Planning Agency for Pinellas County and the
PCPC has adopted guidelines with reference to such required
referral process; and
WHEREAS, this Ordinance has been referred to and considered.
by the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,
and "The Zoning Atlas of the City of Clearwater, Florida of 1985",
as amended, is amended to indicate that fact as hereinafter set
out:

of Section 22, Township 29 South, Range 15 East,
run thence N 0°19'55" E, along the section line,
210.0 feet; thence run N 89°23'50" W, parallel to
the North right-of-way line of Woodlawn Avenue
and to Point on the East right-of-way line of Old
Tampa and Gulf Coast Railroad, 43.35 feet; thence
run N 12°40'01" W, along said railroad right-of-way,
14.42 feet; thence run along a curve to the right
and said railroad right-of--way, chord bearing of
N 8°02'01" W, 229.03 feet, arc of 229.23 feet, and
radius of 1417.69 feet; thence run along a curve to
the left and said railroad right-of-way, chord bearing
of N 6°53'07" W, 176.00 feet, arc of 176.12 feet and
radius of 1447.69 feet for the P.O.B.; thence: run along
a curve to the left and said railroad right-of-way,
chord bearing of N 11°04'40" W, 3:3.74 feet,larc of
35.74 feet and radius of 1447.69 feet; thence run
S 89°23'50" E, parallel to the North right-of-way line
of Woodlawn Avenue, 660.60 feet; thence run S 0°19'
55" W, parallel to the said section line, 35.0 feet;
thence run N 89°23'50" W, parallel to North right-
of-way line of Woodlawn Avenue, 653.52 feet to the
P.O.H.
Section 2. The City of Clearwater does hereby certify that
elements thereof adopted pursuant to the LGCPA and directs that
same be forwarded to the LPA for their receipt and appropriate
action.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Should any part or provision of tnis ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part=declared to'be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and
set out and show upon the official zoning atlas of the City of
Clearwater the foregoing amendments as hereinabove set out.
