ORDINANCE NO. 3970-05
AN ORDINANCE AMENDING THE ZONING ATLAS OF THE
CITY OF CLEARWATER, FLORIDA, 1905, AS AMENDED,
BY RECLASSIFYING AND ZONING CERTAIN PROPERTY
AS DESCRIBED HEREIN; PROVIDING FOR REPEAL OF
ORDINANCES OR PAR'I'S OF ORDINANCES IN CONFLICT
HEREWITH TO THE EXTENT OF SUCH CONFLIC'T'; PRO-
VIDING FOR THE SEPARABILITY OF THE PROVISIONS
HEREOF; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
WHEREAS, on April 4, 1985, the City Commission of the City
of Clearwater, after proper public notice, held a public hearing
on certain proposed changes to the zoning atlas of the City of
Clearwater in accordance with procedure as established; and
WHEREAS, certain of the proposed changes and amendments to the
zoning atlas were approved by the City Commission after its
evaluation of all evidence presented at the said public hearing;
and
WHEREAS, the Local Government Comprehensive Planning Act
(LGCPA) requires that all development regulations and amendments
thereto related to an adopted comprehensive plan or element thereof
be reviewed by the Local Planning Agency (LPA) for conformance with
plans adopted pursuant to the LGCPA; and
WHEREAS, the Pinellas County Planning Council. (PCPC) has been
designated the Local. Planning Agency for. Pinellas County and the
PCPC has adopted guidelines witli reference to each required
referral process; and
WHEREAS, this ordinance has been referred to and considered
by the PCPC under said process;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. The following described property in Clearwater,
Florida, is hereby classified and zoned as hereinafter indicated,
and "The Zoning Atlas of the City of Clearwater, Florida of 1985",
as amended, is amended to indicate that fact as hereinafter set
out:

Zoned PS - Professional Services District
A parcel within the municipal boundaries of the
City of Clearwater, all in the NW 1/4 of the SW 1/4
of Section 6, Township 29 South, Range 16 Bast,
Pinellas County, Florida, consisting of a 9.96 foot
strip along the westerly right-of-way line of
Glenville Drive, and the West 14.00 feet of Lot 6,
College Park Unit 11, as recorded in Plat Book 69,
page 87, Public Records of Pinellas County, Florida,
being .further described as follows:
Begin at the NW corner of the said Lot 6, College Park
[Unit II, also the P.O.B., and .run thence along the
southerly right-of-way line of Sunset Point Road,
N 89°51129" 14.0 feet; thence, along a line parallel
and 14 feet from the West line of the said Lot 6,
8 00°38'34" W, 107,38 feet to a point along the northerly
right-of-way line of Albright Drive; thence along
the said right-of-way line, N 89°21'25" W, 14.00 Feet;
thence, along the westerly right-of-way line of Glenville
Drive:, S 00°38'34" W, 1,163.08 feet; thence S 89°59'48" W,
9.96 feet; thence, along a line parallel to and 9.96 feet
from the said westerly right-of-way line of Glenville
Drive, N 00°38'34" 1;, 1,255.71 feet to the easterly
right-of-way line of Belcher Road; thence along the said
right-of-way line, N 34°49'32" S, 17.73 feet to the
P.O.B.
Section 2. The City of Clearwater does hereby certify that
the measures contained in this ordinance are consistent and in
conformance with the City's Comprehensive Plan and individual..
elements thereof adopted pursuant to the LGCPA and directs that
same be forwarded to the LPA for their receipt and appropriate
action.
Section 3. All ordinances or parts of ordinances in conflict
herewith are to the extent of such conflict hereby repealed.
Section 4. Should any part or,provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
Section 5. Notice of the proposed enactment of this ordinance
has been rpoperly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 6. The Planning Director is directed to include and
set out and show upon the official zoning atlas of the City of
Clearwater the foregoing amendments as hereinabove set out.
