3957-85h ORDINANCE NO. 3957•-05 AN ORDINANCE OF THE CITY OF CLEAIsWATER, FLORIDA, AMENDING ORDINANCE NO. 2019, RELA'T'ING TO THE Lf1ND USE ELEMEN'T' OF THE COMPRE112,NSIVE PLAN, TO CHANGE 'I'llE LAND USE DESIGNA'T'ION VOR CERTAIN REAL PROPS 1TY WI`I'IIIN THE CITY OF CLEARWA'T'ER; PROVIDING FOR RL11EAL OF CONFLICTING ORDINANCES; PROVIDING FOR PROPER NO'T'ICE: OF PROPOSED ENACTMEN'T'; AND PROVIDING FOR THE EFFECTIVE DATE OF T11'[S ORDINANCE. WHEREAS, the Local Government Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council (PCPC) has bean designated the Local. Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral process; and WHEREAS, this Ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CI'T'Y OF CLEARWATER, FLORIDA: Section 1. Pursuant to the provisions of the Local Government Comprehensive Planning Act, 1975, as amended, and pursuant to all applicable provisions of law, Section 1 of Ordinance No. 2019 is amended by placing the hereinafter described property in the land r use category as follows: Property That part of the W 1/2 of the SE 1/4 of the SE 1/4 of Section 21, Township 29'South, Range 15 East, described as follows: Beginning in the East boundary, of said W 1/2 of the SE 1/4 of the SE 1/4 at a point which is 513 feet South along this boundary, from the NE corner of said tract, .and running thence West parallel to the North boundary of said SE 1/4 of the SE 1/4, 300 feet; thence S 70°56'42" W, 115.72 feet to the Easterly right-of-way boundary of U.S. Highway 19 (now Alt. U.S. Highway 19); thence S 32°36'18" E along this boundary, 208.09 feet, more or less, to a point which bears N 79°56'18" W, 305.9 feet from a point in the East boundary of said W 1/2 of the SE 1/4.,of the SE 1/4, which is 756.05 feet South along this boundary from the NE corner of said W 1/2 of the SE 1/4 of the SE 1/4, run thence S 79°56'18" E, 305.9 feet ORD. 11 3957-85 Land Use Category From: Commercial/Tourist Facilities To: Public/Semi-Public FOR AFFIDAVIT SEE: aP.P..?s 9... ?. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the. LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 9. Notice of the proposed enactment: of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.091, Florida Statutes. Section.5. The provisions of this ordinance shall take,,effect immediately upon its passage.
