ORDINANCE NO. 3948-85
AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
VACATING A PORTION OF A CERTAIN EASEMENT IN
MORNINGSIDE ESTATES, UNIT 4, PINELLAS COUNTY,
FLORIDA; PROVIDING FOR PROPER NOTICE OF PRO-
POSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCE.
Deputy
WHEREAS, it has been requested by Daniel E. Sweeney, owner of
certain real property in Morningside Estates, Unit 4, in the City
of Clearwater, Florida, that the City of Clearwater, Florida,
vacate a certain portion of a drainage and utility easement; and
WHEREAS, after proper public notice and public hearing thereon,
the City Commission finds that said portion of easement is not
necessary nor required for municipal use and it is deemed to be to
the best interest and advantage of the City and the general public
that the same be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That the following:
.The West 20 feet of an existing 30 foot
drainage and utility easement on Lot 371,
Morningside Estates, Unit 4, according to
the map or plat thereof as recorded in Plat
Book 61, page 92 of the Public Records of
Pinellas County, Florida, less the southernmost 20 feet.'
be and the same is hereby vacated, closed and released, and the City
of Clearwater hereby quit claims'and releases all of its right, title
and interest thereto to the persons, firms or corporations entitled
thereto by law.
Section 2. That the City Clerk is hereby directed to record
this ordinance in the Public Records.of Pinellas County, Florida.
Section 3. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.
Section 4. This ordinance shall become effective immediately
upon its passage..
