AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING TITLE V, UTILITIES, OF THE CODE OF ORDINANCES,
CITY OF CLEARWATER, TO ESTABLISH A FIXED MONTHLY FEE
FOR READING, REPAIRING, AND REPLACING LAWN WATER
METERS BASED ON THE SIZE OF THE WATEA METER; PROVIDING
FOR THE ESTABY41SHMENT OF IMPACT FEES FOR LAWN WATER
METERS; PROVIDING FOR AN ANNUAL RATE ADJUSTMENT TO
COMPENSATE FOR THE CONSUMER PRICE INDEX TREND;
PROVIDING) FOR THE REPEAL OF ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR THE
SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR
PROPER NOTICE OF PROPOSED ENACTMENT; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, sewer charges are based upon water usage; and

WHEREAS, the City has established a class of water meters to be used for
irrigation upon which no sewer charge Is assessed; and
WHEREAS, many of these meters are not used for months at a time despite
incurring fixed costs for meter reading, record-keeping, repair and replacement which

are now absorbed by other water customers; and
WHEREAS, no water impact fees are assessed for lawn meters despite the
load seasonal lawn sprinkling places upon system capacity; and
WHEREAS, no compensation or adjustment Is made to offset the effects of
Inflation or deflation;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF CLEARWATER, FLORIDA:
Section 1. That Paragraph c. of Subparagraph (1), Water Rates, of
Subsection (e), Rates, of Section 50.05, Deposit, Fees, Service Charges and Rate
Schedule, of Chapter 50, In General, of Title V, Utilities, of the Code of Ordinances of
the City of Clearwater, Is hereby amended and a new paragraph (g) Is hereby enacted
as follows:
C. Lawn water meters. Lawn water meters shall be charged the regular
domestic rate for water used for Irrigation purposes In accordance
with the ordinances of the City. When combined with the domestic
meter on the same bill, the rate shall be at seventy-eight- eente
(49.40 per ene hundred 400 eagle the current approved domestic
rate per 100 cubic feet plus the followinz base meter charges:

When on a.separate bill, the rate will be charged the regular domestic

Section 3. Should any section, paragraph, sentence or word of this
ordinance be declared for any ieason to be invalid, the same shall not affect the
validity of the ordinance as a whole, or any part thereof other than the part declared
to be invalid.
Section 4. All ordinances or parts of ordinances In conflict herewith are
to the extent of such conflict hereby repealed.
Section 5. Notice of the proposed enactment of this ordinance has been
properly advertised In a newspaper of general circulation in accordance with Section
166.041, Florida Statutes.
Section 6. This ordinance shall become effective immediately upon Its
passage.
