"Occupational license divINIon" shall mean that agency of the city responsible for issuing occupational licenses, and shall include the director of said agency or his designee. The words "public conveyance" when used In this chapter, shall mean any motor or"other vehicle of whatever name called, which is used or operated for the purpose of transporting passengers for hire, fee, or compensation of any kind over, upon or along the public streets, roads, avenues, highways, or other public ways within the city, except this section shall not Include taxicabs, buses operating on regularly established and scheduled routes and lines, chartet• buses or coaches which have their point of origin outside the city and which are reserved for the exclusive use of the occupants, and automobiles (commonly referred to as "U.P" or luxury limousines and characterized by modifications intended to Increase the comfort of passengers within) designed to carry no more than six persons which,are hired by written lease with or without driver to transport the occupants to or from any destination within the city. "Public conveyance company" shall refer to any business entity of whatever nature of composition which is licensed by the occupational license division to operate one or more public conveyances for the transportation of passengers for a hi. re, fee, or compensation of an kind and may be a corporation, partnership, joint venture, natural person, or other individual, association or combined persons or entities. Sec. 62.02. Duties of chief of police generally. It shall be the duty of the chief of police to maintain records of any and all violation, or reported violations, of any Florida state statute or ordinance of the city by any public conveyance operator, public conveyance company manager, or public conveyance company owner where such violations would be material to the issuance, renewal, or revocation of a public conveyance operator's permit or a public -2- conveyance company's occupational license. A summary of said violations and alleged violations shall be forwarded to the city manager annually and upon request by the city manager. Sec. 62.03. Compliance with chapter required. (a) It shall be unlawful to operate or cause to be operated `n the city any public conveyance unless approval for the operation thereof shall have been first given by the police chief as hereinafter provided in this chapter and a permit issued. The following are conditions precedent to the issuance of a public conveyance permits (1) No public conveyance may be operated for hire unless It has first been inspected as provided In section 62.06. (2) , The other distinctive markings required by section 62.07 shall be displayed. (b) To evidence compliance with this chapter, the police chief shall Issue an annual permit to each public conveyance so complying, which permit Is non- transferrable, and which shall be conspicuously displayed according to the directions of the police chief. No public conveyance may be operated for hire in the city without having first been issued a public conveyance permit. The expiration date of the public conveyance permit shall be recorded or marked plainly on the permit, (e) The pollee chief may issue a public conveyance permit to any public conveyance upon satisfactory proof that the vehicle concerned has been Issued a permit, license, or certification by another governmental entity, which permit, license, or certificate is valid and issued in accordance with enacted standards and requirements that are substantially similar, and not less restrictive, than the minimum standards and requirements of this chapter. Sea. 62.05. Annual reports by public conveyance companies. Every public conveyance company licensed to provide public conveyance service in the city shall by October 1st of each year submit to the occupational license division the following information: (1) A description of the motor vehicle being used as a public conveyance, setting forth the make, model, year, color, body style, motor vehicle identification and licensee tax number thereof; (2) Each public conveyance permit number; (3) A list setting forth the current name and address of all drivers employed by, or contracting with, the public conveyance company. Sea 62.08. Restricted areas of operation. See. 62.06. lnopections of public eon;veyances. (a) Every public conveyance company shall be responsible for ensuring that each public conveyance owned, operated, or controlled by it complies with applicable state and federal laws, rules, regulations, and standards regarding motor vehicle safety equipment and devices. Every public conveyance company shall cause every public conveyance that it owns, leases or controls to be inspected at least annually to ensure that each such public conveyance complies with Chapter 318, Florida Statutes, and the public conveyance company shall maintain a permanent registry containing Information on the identity of each public conveyance inspected, the date of the inspection, and nature of any deficiencies or defects discovered, remedial action or service performed, and the name of the inspector. (b) The city manager may require additional inspections of any public conveyance to enforce the provisions of this section, which inspections shall be conducted by persons qualified to perform the inspection requested. (e) A public conveyance which fails to meet the operating and safety requirements of Chapter 318, Florida Statutes, or other applicable law, rule, or regulation shall not be operated for the transportation of passengers for hire until such defect or deficiency has been rectified. Sec. 62.07. Distinctive markings required. Every public conveyance company holding a license to operate one or more public conveyances within the city shall permanently affix by paint or decal to the i ,k (a) - No public conveyance operator shall solicit business or pick up passengers within an area within the city designated by the director of traffic engineering as a bus stop or taxi stand, nor shall any public conveyance load or unload where parking and standing is prohibited. (b) No public conveyance shall have less than three (3) doors. (c) No public conveyance operator shall solicit passengers directly or Indirectly except while such public conveyance Is located at a passenger pick-up station or site upon private property. Jr ' shall be paid by any public conveyance operator to any person in return for obtaining fares or otherwise extending preferential treatment to said public conveyance operator. Sec. 62.09. Use for immoral purposes. It shall be unlawful for the operator of a public conveyance operated in the city to permit any person to accompany or use such public conveyance for the purpose of prostitution, lewdness or assignation, or to direct, take or transport, or to offer or agree to direct, take or transport any, other person with knowledge or reasonable cause to believe that the purpose of such directing, taking or transporting is for the purpose of prostitution, lewdness or assignation. See. 62.10. No driver to drive more than twelve hours a day. It shall be unlawful for any operator to drive or operate a public conveyance for more than twelve (12) hours within any twenty-four (24) hour period. This provision may be suspended by the city manager in cases of manifest necessity or demonstrated emergency. See. 62.11. Authority to promulgate rules. The city manager or his designee shall have authority to promulgate reasonable rules and regulations to enforce the provisions of this chapter. ARTICLE II. BUSINESS LICENSE Sec. 62.12. Required. (a) It shall be unlawful for any person or public conveyance company to own, lease, control, drive, carry on, engage in or conduct the business of operating a one or more public conveyances for the transportation of persons on the public streets of Clearwater or dispatched for hire on the public streets of Clearwater without first having obtained an occupational license from the occupational license division after paying the fee as prescribed by section 71.13. This section shall apply only to public conveyance companies that pick up passengers within the city limits of Clearwater, or which have any office or dispatch facilities located within the city, and specifically shall not apply to non-public-sector buses engaged in intercity transportation as contemplated by Section 341.102, Florida Statutes (1983). Sec. 68.13. Regulation of public eonveynncea (a) No public conveyance shall be operated for hire on the streets, highways, roads, avenues, and public ways of the city until its owner, lessee, or controlling public conveyance company has first obtained a valid occupational license for the public conveyance company and a permit for each public conveyance to be operated for hire within the city. (b) In order to secure an occupational license an applicant must provide information on a form provided by the occupational license division. The applicant must: (1) Be at least 18 years of age; (2) Be a citizen of the United States or an alien admitted for permanent residence who has otherwise been granted employment authorization by the United States Immigration and Naturalization Service; (3) ivot have been convicted of any felony if such violation or violations are related to the operation of a motor vehicle or with the operation of a public conveyance, and not have been convicted of violating any ordinance governing the conduct of public conveyance occupational license holders; (c) Should the applicant for an occupational license hereunder be a corporation or partnership, then.the chief executive officer of the corporation, or if a partnership, the partner with the greatest proprietary interest, shall possess all of the requirements set out in (b) above. Sec. 62.14. hivestigation of application. The hearing shall be held within 15 days of the date the notice Is issued. (d) After revocation of a public conveyance company occupational license hereunder, no application for an occupational license under this chapter shall be accepted or considered for a period of 12 months from the date of revocation. (e) With due cause, in the event of a violation of this chapter which results in an emergency situation In which continued operation by the company endangers the health; welfare or safety of the public, the city manager may suspend any company occupational license hereunder; any such suspension may be made effective immediately and shall remain in force until a hearing Is held as provided herein. ARTICLE M. INSURANCE See. 62.20. Required. (a) It shall be unlawful for the owner, operator, or driver of any public conveyance to drive or operate the same or to permit the same to be driven or operated upon the public streets of the city unless such owner, operator, or driver shall have first procured and filed with the city clerk a liability insurance policy, upon which the city Is listed as an additional insured party, issued by a good and responsible insurance company, or a surety bond issued by a good and responsible surety company; such insurance company or surety company must have authority to do business as such in the state. (b) In lieu of subsection (a), the public conveyance company, owner, operator, or driver may make application to the State of Florida pursuant to F.S. Sect. 324.031, to qualify as a self-insurer in the same amounts as required above. Such owner, operator, driver or chauffeur shall file with the city clerk a copy of the application and all documentation filed with the State of Florida. Upon approval of such application by the State of Florida, a current copy of such approval shall be filed with the occupational license division. Upon filing such grant of approval from the State of Florida with the occupational license division, such owner, operator, or driver shall be entitled to function as a self-insurer until such time as the approval is revoked, cancelled or otherwise terminated. See. 62.21. Type; cancellation. (a) The policy of insurance or surety bond under this article may be in the form of a separate policy or separate surety bond for each public conveyance or may be in the form of a "fleet policy" covering all public conveyances operated by such public conveyance company, owner, operator, or driver, in which latter event such policy of insurance or surety bond shall provide the same liability for each public conveyance operated in service, as specified above. (b) No policy of insurance or surety bond as provided in this article shall be cancelled until the expiration of 30 days after notice of intended cancellation thereof has been given in writing to the city clerk by registered mail or personal delivery of such notice, and a provision therefor shall be embodied in the policy or surety bond. ARTICLE IV. PUBLIC CONVEYANCE OPERATORS PERMIT Sec. 62.30. Require& (a) It shall be unlawful for any person to operate or drive a public conveyance In or upon the streets of the city unless and until such person shall have first obtained from the chief of police of the city a public conveyance operator's permit, as provided in this article. -9- Ord. 3927-86 4/4/86 wd.wCrrci:.z7 i.3JfsJ.G'3? i 0 I 0 (b) The possession of a valid public conveyance operator's permit or license issued pursuant to the rules, standards, or laws of another governmental agency, which rules, standards, or laws meet or exceed the minimum requirements of this chapter regarding operator qualifications, shall entitle the person to whom the permit or license has been issued to a public conveyance operator's permit so long as the applicant continues to meet the minimum requirements of section 82.31. The chief of pollee may ensure such compliance by requiring the application to execute a sworn affidavit on a form provided by the police department. See. 82.31. Application. In order to receive a public conveyance operator's permit, an applicant must provide the following information on a form provided by the chief of police. The applicant must: 1. (a) Be at least eighteen (18) years of age; (b) Possess a valid Florida chauffer's license; (c) Be a citizen of the United States or an alien admitted for permanent residence or who has otherwise been granted employment authorization by the United States Immigration and Naturalization Service; (d) Exhibit a proficiency with the English language so as to be able to comprehend and interpret traffic signs; issue written receipts to passengers; and obey lawful'orders of police and others in lawful authority; (e) Be fingerprinted by the police department and supply to the police department two (2) current photographs, size two and one-half (2 1/2) inches by two and three-fourths (2 3/4) inches, accurately depicting the applicant's face and shoulders, or permit the department to take such photographs; (f) Submit an affidavit or affidavits from a public conveyance company, on forms provided by the police department, showing that the applicant will be affiliated as a driver with the public conveyance company upon issuance of the operator's permit. (h) Not have been convicted for a period of two (2) years prior to the date of application of the violation of any statute or ordinance governirg the conduct of drivers of vehicles for hire. (2) Failure on the part of the applicant to demonstrate through the information provided on the application described herein, as well as the fingerprints and pictures that such applicant meets or possesses the described qualifications shall be grounds, for denying the permit. (3) All drivers of vehicles for hire holding current operator's permit from the City of Clearwater are hereby permitted to continue to operate until expiration of such permits. Thereafter, each driver must obtain a new permit issued pursuant to this section. Each such applicant mast meet the criteria set forth in this section. The permit so Issued shall be valid until the driver's next birthday. (4) After the initial issuance of a permit, the permit shall be renewed by the driver during the month of the driver's birthday upon providing proof that the driver continues to possess the requirements necessary to obtain and maintain a permit as set forth above. (5) Any driver who intends to change his or her public conveyance company affiliation must present his or her operator's permit to the pollee department so that such permit may be replaced with a substitute permit reflecting such change of affiliation. Under no circumstances shall the driver drive with the public conveyance company with which he or she intends to affiliate before obtaining a substitute permit. It shall be unlawful for any person holding a public conveyance operator13 permit to willfully alter, deface, obliterate or destroy the same or to cause or permit the same to be altered, defaced, obliterated or destroyed. Bee. 62.33. Revocation or suspension of public conveyance operator's permit; ground notice; hearing, emergency situations; prohibited aebL (a) Upon a finding of due cause as hereinafter defined, the chief of police shall have the authority to revoke or suspend any operator's permit which has been issued or may hereafter be Issued by the city. (b) "Due cause" (for the revocation or suspension of an operator's permit) shall include but not be limited to the following: (1) The failure of the driver to maintain any and all of the general qualifications applicable to the initial, issuance of a permit hereunder; (2) Obtaining a permit by providing false information; (3) Violation by a driver of any of the following offenses: a. Driving under the influence of intoxicating beverages or drugs; b. Criminal homicide, rape, aggravated battery, burglary, aggravated assault, kidnapping, robbery, child molestation, grand theft, criminal solicitation to commit or attempt to commit any of the above-.listed crimes, unlawful possession, sale or distribution of any controlled substance which is regulated or prohibited by Chapter 893, Florida Statutes, or a violation of any ordinance of the City of Clearwater governing the conduct of drivers of a public conveyance; C. Providing false information to the chief of police; d. Charging a fee In excess of those fees posted and displayed in accordance with section 62.40,- e. Violation of any ordinance or law, other than minor traffic offenses, in connution with the operation of a public conveynriee; r. Whenever it shall appear that an operator has disorders characterized by lapses of consciousness or other mental or physical disabilities affecting his or her ability to drive safely; g. The public conveyance company shall at all times know the status of its operator's permits with regard to expiration, suspension, or revocation. (1) Any operator whose permit has been suspended or revoked shall . ,,;•i '. surrender said permit to the chief of police and it shall be unlawful to possess an operator's permit during the period of such suspension or revocation. At the conclusion of the period of suspension or revocation, the applicant may reapply for a new operator's permit. 11" ARTICLE V. RATES See. 62.40. Posting of crate schedule. No public conveyance shall transport passengers from a point within the city to another point or destination, except to the extent that such public conveyance , f;riw has a tour schedule which includes rates on file with the chief of police. Such rates shall also be visibly posted within each vehicle and at such locations as are designated or utilized by a public conveyance as a fixed passenger pick-up point. Sec. 62.41. Advance payment. Every operator shall have the right to demand payment of the legal fare in cash in advance, and may refuse employment unless so prepaid. Sec. 62.42. Nonpaying passengers prohibited. It shall be unlawful for any operator of any public conveyance to carry in such public conveyance any person except fare-paying passengers or employees of the persons by which the public conveyance is owned or operated. This restriction shall not apply to the use of such public conveyance by a public safety officer of this City during an emergency. Sec. 62.43. Receipts. If demanded by the passenger, the operator shall deliver to any passenger at the time of payment a receipt therefor in legible writing, containing the name of the owner, the city license number, or the operator's permit number, if license be required, showing upon the receipt all items for which a charge is made, the total amount paid, and the date of payment. Section 2.
