" ORDINANCE; NO. 3920-85 AN ORDIIANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING ORDINANCE; NO. 2019, RELATING TO THE LAND USt' ELEMENT OF THE COMPREHENSIVE PLAN, TO CHANGE THE LAND USE DESIGNATION FOR CERTAIN REAL PROPER'T'Y WITHIN THE CITY OF CLEARWATER; PROVIDING FOR ` REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR ' PROPER NOTICE OF PROPOSED ENACTMENT; AND PRO- VIDING FOR THE EFFECTIVE DA'T'E OF THIS ORDINANCE. WHEREAS, the Local Goernment Comprehensive Planning Act (LGCPA) requires that all development regulations and amendments thereto related to an adopted comprehensive plan or element thereof be reviewed by the Local Planning Agency (LPA) for conformance with plans adopted pursuant to the LGCPA; and WHEREAS, the Pinellas County Planning Council. (PCPC) has been designated the Local Planning Agency for Pinellas County and the PCPC has adopted guidelines with reference to such required referral q", process; and WHEREAS, this ordinance has been referred to and considered by the PCPC under said process; NOW, THEREFORE, BE IT ORDAINED .BY THE CITY ltt': COMMISSION OF THE CITY OF•CLEARWATER, FLORIDA: Section 1. Pursuant to the provisions of the Local Govern- ment Comprehensive Planning Act, 1975, as amended, and pursuant to all applicable provisions of law, Section 1 of Ordinance No. 2019 is amended by placing the hereinafter described property in the land use category as folows: ?'. Property Land Use Category ,(L.U.P. 85-•1) That portion of land From: High Density Residential F.+ lying and being in the N 1/2 of the NE 1/4 of the SW 1/4 of Section 15, To: Residential/Office Township 29 South, Range 15 East, described as follows: Commence at the SW corner of the N 1/2 of the NE 1/4 of the SW 1/4 of said Section 15, and run S 89°1010611 E, 30.0 feet to the East right-of--way line of Greenwood Avenue for a P.O.B,; from this located P.O.B. continue S 89°10106" E, 140.54 feet along the South boundary of the said = N-1/2 of the NE 1/4 of the SW 1/4 of said Section 15 as established by Case No. 41781 in Chancery in the Circuit Court of the Sixth Judicial Circuit of the State of Florida in and for Pinellas County, Florida; thence run N 0°27'36" E, 132.02 feet :.'.-. to an intersection with the South boundary of Turner Street; thence" 5 run N 89°10k0611 W along South boundary FOR AFFIDAVIT SEE: of Turner Street, 141.45 feet to the f 9A C East boundary of Greenwood Avenue; ORD. The City of Clearwater does hereby certify that the measures contained in this ordinance are consistent and in conformance with the City's Comprehensive Plan and individual elements thereof adopted pursuant to the LGCPA and directs that same be forwarded to the LPA for their receipt and appropriate action. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Notice of the proposed enactment of this ordinance has been properly,advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5.
