„- WHEREAS, thc curs-ent Water impact fee of the City was adopted
in 1900, and it its necessary to increase this fee in order to cover
current costs of system improvements caused by new development; and
WHEREAS, in order to provide n more equitable system of deter--
mination of impact caused by non-residential development, it is
necessary to adopt: a ayitem based upon meter sizes; and
WHEREAS, these chnngen will not be an expense to current resi-
dents, but will appropriately pans on to developers the propor-
tionate coats of expansion necessitated by development;
NOW, THEREVOR1., BE. 11' ORDAINED BY THE CITY
COMMISSION O.'' THE CITY OIL CLEARWATER, FLORIDA:
Section 1. That Subparagraph (1), Water, of Subsection (c),
Impact fees, of Suction 50.05, Deposit, fees, service charges,and
rate schedule, of Chapter 50, In General, of Title V, Utilities,
of the Code of Ordinances, City of Clearwater, be and the same is
hereby amended to read as follows:
(e) Impact fees:
(1)'Water. There is hereby imposed a water impact
fee, based on the capital portion of the cost of
financing the extension of the city's water system,
on the equivalent single-family residential unit
which is responsible for creating the need for
additional water system financing. The obligation
for payment of the fee shall occur at the time
the first building or plumbing permit is issued.
The,water impact fee shall be as follows:
a. .'For each equivalent single--family

b. For each non-residential, commercial and
industrial account (including motels and

C. Each additional equivalent single-family
residential unit occasioned by changes in
property'usage subsequent to the offective
date of this subsection shall be subject to a
development fee computed in accordance with
whichever of the foregoing criteria is
applicable. if a building permit is issued
for an'existing nonresidential, commercial or
industrial connection which will increase
water or sewer demand, or if a building
changes from residential to non-residential
occupancy, the total number of equivalent
single-family residential units for the old
and new parts of the facility shall be computed
as outlined in subsection (c) (1) (b) above.
The number of new equivalent single-family
residential units shall be determined by sub-
tracting the number of old equivalent single-
family residential units in the entire facility.
The water impact fee will be assessed on the
remaining number of new equivalent single-
family residential units.
d. Whenever any work for which an impact tee is
?. required by this code has been commenced without
first oavinq such fee. then such fee shall be tripled
Section 2, All ordinances or parts of ordinances in conflict
'herewith are to the extent of such conflict hereby repealed.
Section 3. Should any part or provision of this ordinance be
declared by a court of competent jurisdiction to be invalid, th
same shall not affect the validity of the ordinance as a whole, or
any part thereof other than the part declared to be invalid.
Section 4. Notice of the proposed enactment of this ordinance
has been properly advertised in a newspaper of general circulation
in accordance with Section 166.041, Florida Statutes.-
