HEAL'T'H AND SAFETY, OF THE CODE OF ORDINANCE, CITY OF CLEARWATER, TO PROVIDE AN ADDITIONAL EXCEPTION IN UNLAWFUL DISCRIMINATORY PRACTICES IN PUBLIC ACCOMMODA'T'IONS; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PRO- VIDING FOR THE RIrPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH TO THE EXTENT OF D ., SUCH CONFLICT; PROVIDING FOR PROPER NOTICE OF TN PROPOSED ENACTMENT; AND PROVIDING FOR THE EFFECTIVE DAVE OF THIS ORDINANCE. ` WHEREAS, it would be to the bast interests of the citizens of Clearwater, Florida, to allow businesses engaged in the sale or ' dispensing of alcoholic beverages to limit their clientele to persons who have attained the age of twenty-one years or older; and ? ? WHEREAS, the Code of Ordinances should be amended in order to permit such action which would benefit the citizens at large; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That subsection (b), of Section 99.11, Unlawful discriminatory practices in public accommodations; exceptions, of Chapter 99, Community Relations, of Title VIII, Public Health and Safety, of the Code of Ordinances, City of Clearwater,-be amended to enact a new paragraph (3) ?o read as follows: (3) Any establishment engaged in the sale or dispensing of alcoholic beverages for consumption s on the premises, with regard to the imposition of " a minimum age as a prerequisite to the entry upon , said premises during all or any portion of the period of time that such establishment is permitted a_ to be open to the public, but such minimum age restriction shall not exceed twenty-one years of age. However, if an establishment so limits the sale of t. alcoholic beverages, it shall (a) clearly post a notice t. of this restriction both inside and outside the establishment; (b) notify in writing the Clearwater Office of Community Relations, the City Attorney's Office, and the Chief of Police of this prohibition; (c) retain any policy regarding age limitation for a ?r period.of at least six (6) months;.and (d) if the , establishment wishes to change such a policy, a three " (3) months' notice prior to the change be given in writing to the Clearwater Office of Community Relations, the City Attorney's Office, and the.Chief of Police. Section 2. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than the cart declared to be invalid. r;.
