AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDAr AMENDING CHAPTER 112, STREET AND SIDEWALK CON- STRUCTION AND USE, OF TITLE IX, STREETS, SIDEWALKS AND OET'HER,PUBLIC PLACES, OF THE CODE OF ORDINANCES, CITY OF CLEARWA`T'ER, TO PROHIBIT PLACEMENT OF CERTAIN LISTED MATERIALS ON THE RIGHT-OF-WAY OF ANY ROAD OR STREET OR ON ANY SIDEWALK; TO PERMIT REMOVAL OF HANDBILLS, BILLBOARDS OR SIGNS FOUND POSTED; TO HOLD THE PERSON RESPONSIBLE FOR ANY SUCH ILLEGAL POSTING FOR COSTS INCURRED IN THE REMOVAL OF SAME; PROVIDING THAT NO VEHICLE SHALL•BE PARKED ON ANY PUBLIC STREET OR ALLEY WITHOUT HAVING A VALID TAG LEGALLY DISPLAYED; PROVIDING THAT NO VEHICLE SHALL BE REPAIRED ON ANY STREET OR ALLEY EXCEPT FOR EMERGENCY REPAIRS; PROVIDING FOR THE SEPARABILITY OF THE PROVISIONS HEREOF; PROVIDING FOR THE REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- WITH TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR PROPER NOTICE OF PROPOSED ENAC'T'MENT; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Sectin 1. That Section 112.27, Prohibition of placement of .certain structures and materials, of Article III, Street, Sidewalk and Right-of-Way Use, of Chapter 112, Street and Sidewalk Construction and Use, of Title IX, Streets, Sidewalks.and Other Public Places, of the Code of Ordinances, City of Clearwater, be and the same is hereby amended to read as follows: Sec. 112.27. Prohibition of placement of certain structures and materials. (a) No person shall paint, mark or write on,_or_post or _otherwise affix, any handbill, billboard or sign to or upon any sidewalk, crosswalk curb, curbstone,' street lam ost h•draht tree shrub tree stake or guard, railroad trestle electric light or power or telephone or telegraph wire Ole or wire_ appurtenance thereof or upon an fixture of the fare alarm or police tele ra h system or upon an lighting system, public bridge, drinking fountain street sign or traffic-sign or erect the same within the limits of the right-of-way of an road or street or on an sidewalk. C3L?'t?2^ i aa° ? i _ U "(b) No parson shall erect, place, park or locate any structure, game, vehicle, boat, trailer, display materials, merchandise or similar object within the limits of any public street, road, or highway where prohibited by officinal sign or traffic control device, or on any outer public right,-of-way adjacent to any such public street, road, or highway unless otherwise permitted by the Director of Public Works. No object or thing heretofore described may be placed upon any median located within the City, regardless of the posting 'of any sign or traffic control device. (c) No vehicle which is required by Florida Statutes to be registered and to display a registration plate or license tag whenever operated on the public, streets or hiahwavs shall be operated: parked, or highway, alley or other vehicular way without havi said valid plate or tag l6gally, legibly and prominently displayed. (d) No vehicle, trailer, or machine of whatever kind shall be remodeled restored or repaired on an street, highway, alley or other roadway{, exept that this section shall not amply to'-,tne oerformin of certain unanticipated emergency repairs such as tire-chanaina or fuse replacement when such repair traffic or otherwise creating a safety hazard to the operator or occupants of the-disabled vehicle and other vehicular traffic using the roadway. (e)4-e} The director of the department of public works shall have the authority to cause each item determined to be in violation of paragraphs-J r)- and- Jb) to be removed after first notifying the owner, it the owner can be found. The notice shall be given to the owner or person responsible for the item at least twenty- four (24) hours before the item is removed. The notice shall provide the section or sections of the code being violated and shall inform the owner or person responsible to remove the item or show-cause prior to the expiration of the twenty-four-hour period why the item should not be removed. Where the owner cannot be found, the director shall post the notice described herein on the item scheduled to be removed at least thirty-six (36) hours prior to its removal. As defined herein, "cause" shall mean a permit or other written permission's granted by the city. Where the director removeS•a the iteri identified in paragraphs-faJ-ar3F'•-(bY the owner of such object may recover the same upon paying a removal and storage charge to cover the city's cost, but in any event not less than twenty- five dollars ($25.00). (f)+0 The provisions of paragraph (a) shall not apply with respect to any bench containing advertising matter where the city has previously granted written permission to place the advertising m«tter on such bench. (g) {.P} The provisions of paragraph (b) shall not apply to any vehicle parked on right-of-way by reason of the zoning attached.to the adjoining property and permission previously'granted to occupy such right-of-way. -2- Ord. 3872-85 2/7/85 r 00k94 Property which has been removed from the right-of-way in accordance with the provisions of this section including the notice provisions, and which has not been reclaimed by the owner not forth on the notice within thirty (30) days of the data of the notice, shall be considered abandoned property. The municipality sha21 have the right to use or dispose of such property. Funds collected from disposal shall be applied against all costs incurred by the city in removing such property from the right-of-way. The notice provided for in subpnragraph ?u} (e) in addition to the other require- ments shall contain a warning that such property will be considered as abandoned property if not claimed within thirty (30) days of data of notice. Section 2. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole, or any part thereof other than they part declared to be invalid. Section 3. All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. Section 4. Notice of the proposed enactment of this ordinance has been properly advertised in a newspaper of general circulation in accordance with Section 166.041, Florida Statutes. Section 5. The provisions of this ordinance shall take effect immediately upon its passage.
